On a wet spring day in June, fog shrouded the Mission Mountains on the Flathead Indian Reservation in northwest Montana. Silver beads of rain clung to blades of grass and purple lupine. On a ridge overlooking St. Mary’s Lake in the southeastern corner of the reservation, the land was mostly cleared of trees after state-managed logging operations. Some trees remained, mainly firs and pines, spindly things that once grew in close quarters but now looked exposed without their neighbors.

Viewed from the sky, the logged parcel was strikingly square despite the mountainous terrain. It stood in contrast to the adjacent, tribally managed forest, where timber operations followed the topographic contours of watersheds and ridgelines or imitated fire scars from lightning strikes.

“It’s not that they’re mismanaging everything, but their management philosophy and scheme do not align with ours,” said Tony Incashola Jr., the director of tribal resources for the Confederated Salish and Kootenai Tribes, or CSKT, as he looked out the window of his Jeep at the landscape. “Their tactics sometimes don’t align with ours, which in turn affects our capability of managing our land.”

This nearly clear-cut, 640-acre parcel is state trust land and is a small part of the 108,886 state-owned acres, above- and belowground, scattered across the reservation — this despite the tribal nation’s sovereign status.

The Douglas fir and ponderosa pine trees that remained in the square would thrive on the occasional fire and controlled burn after logging operations, benefiting the next generation of trees. Instead, the area was unburned, and shrubs crowded the ground. “I see this stand right here looking the exact same in 20 years,” said Incashola. It’s his first time being on this land, despite a lifetime on the reservation — because it’s state land, the gate has always been locked.

State trust lands, on and off Indian reservations, make up millions of acres across the Western United States and generate revenue for public schools, universities, jails, hospitals and other public institutions by leasing them for oil and gas extraction, grazing, rights of way, timber, and more. The state of Montana, for example, manages 5.2 million surface acres and 6.2 million subsurface acres, a term pertaining to oil, gas, minerals, and other underground resources, which distributed $62 million to public institutions in 2023. The majority of that money went to K-12 schools — institutions serving primarily non-Indigenous people.

States received many of these trust lands upon achieving statehood, but more were taken from tribal nations during the late 19th and early 20th centuries through a federal policy of allotment, in which reservations were forcibly cut up into small parcels in an effort to make Indigenous peoples farmers and landowners. The policy allowed for about 90 million acres of reservation lands nationwide to move to non-Indigenous ownership. On the Flathead Reservation, allotment dispossessed the CSKT of a million acres, more than 60,000 of which were taken to fund schools.

But the Flathead Reservation is just one reservation checkerboarded by state trust lands. 

To understand how land and resources taken from Indigenous peoples and nations continue to enrich non-Indigenous citizens, Grist and High Country News used publicly available data to identify which reservations have been impacted by state trust land laws and policies; researched the state institutions benefiting from these lands; and compiled data on many of the companies and individuals leasing the land on those reservations.

Altogether, we located more than 2 million surface and subsurface acres of land on 79 reservations in 15 states that are used to support public institutions and reduce the financial burden on taxpayers. In at least four states, five tribal nations themselves are the lessees — paying the state for access to, collectively, more than 57,700 acres of land within their own reservation borders.    

However, due to instances of outdated and inconsistent data from federal, state, and tribal cartographic sources, our analysis may include lands that do not neatly align with some borders and ownership claims. As a result, our analysis may be off by a few hundred acres. In consultation with tribal and state officials, we have filtered, clipped, expanded, and otherwise standardized multiple data sets with the recognition that in many cases, more accurate land surveying is necessary.

The state trust lands that came from sanctioned land grabs of the early 20th century helped bolster state economies and continue to underwrite non-Indian institutions while infringing on tribal sovereignty. “The justification for them is very old. It goes back to, really, the founding of the U.S.,” said Miriam Jorgensen, research director for the Harvard Project on Indigenous Governance and Development. The goal, she said, was to help settlers and their families gain a firmer foothold in the Western U.S. by funding schools and hospitals for them. “There’s definitely a colonial imperative in the existence of those lands.”

Although tribal citizens are a part of the public those institutions are supposed to serve, their services often fall short. On the Flathead Reservation, for example, Indigenous youth attend public schools funded in part by state trust lands inside the nation’s boundaries. However, the state is currently being sued by the CSKT, as well as five other tribes, over the state’s failure over decades to adequately teach Indigenous curriculum despite a state mandate to do so.  Arlee High School is a public school on the Flathead Reservation. Six tribes, including CKST, have sued the state of Montana for failing to implement its Indian Education for All curriculum in public schools over the past few decades, despite a mandate to do so.

Since 2022, the CSKT and the state of Montana have been negotiating a land exchange in which the tribe will see some 29,200 acres of state trust lands on the reservation returned, which could include the logged, 640-acre parcel near St. Mary’s Lake. In the trade, Montana will receive federal lands from the Department of the Interior and the Department of Agriculture, or potentially both, elsewhere in the state. Such a return has been “the want of our ancestors and the want of our tribal leaders since they were taken,” Incashola said. “It’s not a want for ownership, it’s a want for protection of resources, for making us whole again to manage our forests again the way we want to manage them.”

Tribal nations and states have struggled with state and federal governments over jurisdiction and land since the inception of the United States, says Alex Pearl, who is Chickasaw and a professor of law at the University of Oklahoma. But the potential return of state trust lands represents an opportunity for LandBack on a broad scale: an actionable step toward reckoning with the ongoing dispossession of territories meant to be reserved for tribes. “The LandBack movement that started as protests has become a viable policy, legally,” Pearl said. 

The Uintah and Ouray Indian Reservation is one of the largest reservations in the U.S., stretching 4.5 million acres across the northeastern corner of Utah. But on closer look, the reservation is checkerboarded, thanks to allotment, with multiple land claims on the reservation by individuals, corporations, and the state of Utah. Altogether, the Ute Tribe oversees about a quarter of its reservation.

The state of Utah owns more than 511,000 surface and subsurface acres of trust lands within the reservation’s borders. And of those acres, the Ute Tribe is leasing 47,000 — nearly 20 percent of all surface trust land acreage on the reservation — for grazing purposes, paying the state to use land well within its own territorial boundaries. According to Utah’s Trust Lands Administration, the agency responsible for managing state trust lands, a grazing permit for a 640-acre plot runs around $300. In the last year alone, the Utes have paid the state more than $25,000 to graze on trust lands on the reservation.

Of all the Indigenous nations in the U.S. that pay states to utilize their own lands, the Ute Tribe leases back the highest number of acres. And while not all states have publicly accessible lessee information with land-use records, of the ones that did, Grist and High Country News found that at least four other tribes also lease nearly 11,000 acres, combined, on their own reservations: the Southern Ute Tribe, Navajo Nation, Pueblo of Laguna, and Zuni Tribe. According to state records, almost all of these tribally leased lands — 99.5 percent — are used for agriculture and grazing. 

The Pueblo of Laguna, Zuni, part of the Navajo Reservation, and Ramah Navajo, a chapter of Navajo Nation, are located in the state of New Mexico, which owns nearly 143,000 surface and subsurface acres of state trust lands across a total of 13 reservations. The Navajo Nation leases all 218 acres of New Mexico state trust lands on its reservation, while the Ramah Navajo leases 17 percent of the 24,600 surface state trust land acres within its reservation’s borders. The Pueblo of Laguna leases more than half of the 11,200 surface trust land acres in its territory, while the Zuni Tribe leases 37 of the 60 surface trust land acres located on its reservation. The nations did not comment by press time.

Cris Stainbrook, president of the Indian Land Tenure Foundation, said that for tribes, the cost of leasing state trust lands on their reservations for grazing and agriculture is likely lower than what it would cost to fight for ownership of those lands. But, he added, those lands never should have been taken from tribal ownership in the first place.

“Is it wrong? Is it fundamentally wrong to have to lease what should be your own land? Yes,” said Stainbrook. “But the reality of the situation is, the chances of having the federal or state governments return it is low.”

In theory, tribal nations share access to public resources funded by state trust lands, but that isn’t always the case. For example, Native students tend to fare worse in U.S. public schools, and some don’t attend state-run schools at all. Instead, they enroll in Bureau of Indian Education schools, a system of nearly 200 institutions on 64 reservations that receive funding from the federal government, not state trust lands. 

Beneficiaries, including public schools, get revenue generated from a variety of activities, including leases for roads and infrastructure, solar panel installations, and commercial projects. Fossil fuel infrastructure or activity is present on roughly a sixth of on-reservation trust lands nationwide.

While state agencies can exchange trust lands on reservations for federal lands off-reservation, the process is complicated by the state’s legal obligation to produce as much money as possible from trust lands for its beneficiaries. Still, some states are attempting to create statewide systematic processes for returning trust lands. 

At the forefront are Washington, which is currently implementing legislation to return lands, and North Dakota, which is moving new legislation through Congress for the same purpose. But because of the lands’ value and the states’ financial obligations, it’s difficult to transfer complete jurisdiction back to Indigenous nations. Trust lands must be swapped for land of equal or greater value, which tends to mean that a transfer is only possible if the land in question doesn’t produce much revenue.

That’s the case with Washington’s Trust Land Transfer program, which facilitates exchanges of land that the state’s Department of Natural Resources, or DNR, deems unproductive. Those lands are designated as “unproductive” because they might not generate enough revenue to cover maintenance costs, have limited or unsustainable resource extraction, or have resources that are physically inaccessible. A 540-acre plot of land that was transferred to the state Department of Fish and Wildlife in a 2022 pilot program was considered financially unproductive because “the parcel is too sparsely forested for timber harvest, its soils and topography are not suitable for agriculture, it offers low potential for grazing revenue, it is too small for industrial-scale solar power generation, and it is located too close to the 20,000-acre Turnbull National Wildlife Refuge for wind power generation.”

Currently, Washington’s state constitution does not allow for the exchange of subsurface acreage; the DNR retains mineral rights to state trust lands even after exchange. Transfers are funded by the state, with the Legislature paying the DNR the value of the land to be exchanged so the agency can then purchase new land. The value of all the lands that can be exchanged is capped at $30 million every two years.

Even that money isn’t guaranteed: The legislature isn’t obligated to approve the funding for transfers. Additionally, the program is not focused solely on exchanges with Indigenous nations; any public entity can apply for a land transfer. Through the pilot program in 2022, the state Department of Fish and Wildlife, Department of Natural Resources, and Kitsap County received a total of 4,425 acres of federal land valued at more than $17 million in exchange for unproductive trust lands. All three entities proposed using the land to establish fish and wildlife habitat, natural areas, and open space and recreation. None of the proposed projects in the pilot program had tribes listed as receiving agencies for land transfer. However, six of the eight proposals up for funding between 2025 and 2027 would be transferred to tribal nations.

In North Dakota, the Trust Lands Completion Act would allow the state to exchange surface state trust lands on reservations for more accessible federal land or mineral rights elsewhere. The legislation made it through committee in the U.S. Senate last year and, this fall, state officials hope to couple it with bigger land-use bills to pass through the Senate and then the House.

But one of the legislation’s main caveats is that it, like Washington, excludes subsurface acres: North Dakota’s constitution also prohibits ceding mineral rights. North Dakota currently owns 31,000 surface and 200,000 subsurface acres of trust lands on reservations. State Commissioner of University and School Lands Joe Heringer said that returning state trust lands with mineral development would be complicated because of existing development projects and financial agreements.

Right now, the only mineral development happening on reservation-bound state trust lands is on the Fort Berthold Reservation in the state’s northwestern corner, with the Mandan, Hidatsa, and Arikara Nation, also known as the Three Affiliated Tribes. 

Initial oil and gas leases are about five years, but they can stay in place for decades if they start producing within that time. “There’s already all sorts of leases and contracts in place that could get really, really messy,” Heringer said.

By design, subsurface rights are superior to surface rights. If land ownership is split — if a tribe, for instance, owns the surface rights while an oil company owns the subsurface rights — the subsurface owner can access its resources, even though the process might be complicated, regardless of what the surface owner wants.

“It’s not worthless, but it’s close to it,” Stainbrook said of returning surface rights without subsurface rights. 

Still, Stainbrook acknowledges that programs to return state trust lands are meaningful because they consolidate surface ownership and jurisdiction and allow tribes to decide surface land use. Plus, he said, there’s a lot of land without subsurface resources to extract, meaning it would be left intact. But split ownership, with tribes owning surface rights and non-tribal entities holding subsurface rights, prevents tribes from fully making their own choices about resource use and management on their lands. And states are not required to consult with tribes on how these lands are used.

“In the sense of tribal sovereignty, it has not increased tribal sovereignty,” Stainbrook said. “In fact, I mean, it’s pretty much the status quo.”

Of the 79 reservations that have state trust lands within their boundaries, tribal governments of 49 of them have received federal Tribal Climate Resilience awards since 2011. These awards are designed to fund and assist tribes in creating adaptation plans and conducting vulnerability and risk assessments as climate change increasingly threatens their homes. But with the existence of state trust lands inside reservation boundaries, coupled with state-driven resource extraction, many tribal governments face hard limits when trying to enact climate mitigation policies — regardless of how much money the federal government puts toward the problem.

In 2023, a wildfire swept the Flathead Reservation, just west of Flathead Lake. Afterwards, the CSKT and the Montana Department of Natural Resources and Conservation, which manages the state’s trust lands, discussed salvage timber operations — in which marketable logs are taken from wildfire-burned forests — on two affected state trust land parcels, both inside the reservation. The tribe approved a road permit for the state to access and salvage logs on one parcel, but not the other, since it wasn’t as impacted by the fire. Later, the tribe found out that the state had gone ahead with salvage operations on the second parcel, bypassing the need for a tribal road permit by accessing it through an adjacent private property.

That lack of communication and difference in management strategies is evident on other state trust lands on the reservation: One logged state parcel is adjacent to a sensitive elk calving ground, while another parcel, logged in 2020, sits atop a ridgeline and impacts multiple streams with bull trout and westslope cutthroat trout. The uniformity and scale of the state logging — and the prioritization of profit and yield — do not align with the tribes’ forestry plans, which are tied to cultural values and use of land, Incashola said. “Sometimes the placement of (trust lands) affects cultural practices, or precludes cultural practices from happening on those tracts,” he said. “We can’t do anything about it, because they have the right to manage their land.” 

Montana’s Department of Natural Resources and Conservation did not make anyone available to interview for this story, but answered some questions by email and said in a statement that the department “has worked with our Tribal Nations to ensure these lands are stewarded to provide the trust land beneficiaries the full market value for use as required by the State of Montana’s Constitution and the enabling legislation from Congress that created these trust lands.”

Since the 1930s, the CSKT has prioritized reclaiming land, buying private and state trust lands back at market value. Today, the tribe owns more than 60 percent of its reservation.  

While logging used to be the tribe’s main income source, it has diversified its income streams since the 1990s. Now, the tribe’s long-term goal is for its forests to return to pre-settler conditions and to build climate resiliency by actively managing them with fire. The state’s Montana Climate Solutions Plan from 2020 acknowledged the CSKT as a leader on climate and recommended that the state support tribal nations in climate resilience adaptation. However, that suggestion remains at odds with the state’s management of, and profit from, reservation lands. The 640-acre parcel near the Mission Mountains that Incashola had never been able to visit because of the locked gate, for example, abuts tribal wilderness and is considered a sensitive area. Since 2015, the state has made $775,387.82 from logging that area.

The legislation that included the Montana-CSKT land exchange passed in 2020, but progress has been slow. The exchange doesn’t include all the state trust land on the reservation, which means the selection process of those acres is ongoing. The lands within the tribally protected areas, as well as those near the Mission Mountain Wilderness, are of high priority for the CSKT. There are some state lands that are ineligible, such as those that do not border tribal land. But the state has also interpreted the legislation to exclude subsurface acres that could be used for mining or other extractive activities. The tribe is steadfast that subsurface acres are included in the legislation. The impasse has complicated negotiations.

“It’s out-and-out land theft,” said Minnesota State Senator Mary Kunesh of state trust lands on reservations. Kunesh, a descendant of the Standing Rock Sioux Tribe, has authored two bills that returned state land to tribes, each with a decade or more of advocacy behind it.

On the Leech Lake Band of Ojibwe’s reservation in Minnesota, for example, the tribe owns only about 5 percent of the reservation, although federal legislation recently returned more than 11,000 acres of illegally taken national forest. Meanwhile, the state owns about 17 percent. That ownership has an impact. Tribes in Minnesota do not receive revenue from state trust lands on their reservations, nor do tribal schools, Kunesh says. “Hundreds of thousands of millions of dollars that could have perhaps been used to educate, to create housing, to create economic opportunity have been lost to the tribes,” Kunesh said. Still, “it’s not that the tribes want money. They want the land.”

Land return is contentious, but Kunesh has seen support for it from people of all backgrounds while working to pass legislation. “We do need our non-Native communities to stand up and speak the truth as they see it when it comes to returning the lands, and any kind of compensation, back to the tribes.”

But those land returns will also require political support from senators and representatives at both the state and federal level. “Ultimately, it is up to Congress to work with States and other affected interests to find solutions to these land management issues,” the National Association of State Trust Lands’ executive committee said in an email.

In some states, legislators have indicated strong resistance. Utah lawmakers passed a law this year that allows the state’s Trust Land Administration to avoid advertising state land sales. The law gives Utah’s Department of Natural Resources the ability to buy trust land at fair market value, ultimately avoiding possible bidding wars with other entities, like tribes. The legislation came after the Ute Indian Tribe outbid the Department of Natural Resources when trying to buy back almost 30,000 acres of state trust land on their reservation.

“It’s going to have to take the general public to get up in arms over it and say, ‘This is just morally wrong,’” said Stainbrook of the Indian Land Tenure Foundation. “We haven’t gotten to that point where enough people are standing up and saying that.”

Near the southeast edge of the Flathead Reservation is a place called Jocko Prairie — though it hasn’t looked like a prairie for some time — with stands of large ponderosa pines and other trees crowding in, a result of federal fire-suppression practices on tribal lands. The Confederated Salish and Kootenai Tribes have worked to restore the prairie by keeping out cattle, removing smaller trees, and reintroducing fire. Land that was once crowded with thickets of brush is now opening up, and as more sunlight reaches the ground, grasses and flowers have come back. 

This year in early June, a sea of blue-purple camas spread out on the ground under the trees, reactivated by fire after decades of lying dormant. It was a return.

VESTAVIA HILLS, Ala. — Principal Lauren Dressback didn’t think about it after it happened. After all, she was workplace-close with Wesley Smith, the custodian at Cahaba Heights Elementary School, in this affluent suburb of Birmingham. She called him “the mayor.” She said that he knew her two children, asked about her family almost daily and made a point of interacting. “Every day, a huge bear hug,” she recalled.  

So, when Dressback, just after last Valentine’s Day, asked Smith to come into the nurse’s office and shut the door, and then shared three photos on her phone of who she had just started dating, it felt ordinary. Afterward, she said, “I just moved right on about my day.” 

But the 2 minute, 13 second-exchange — captured on video by the nurse — would prove fateful.  

In a few short months, after a two-decade career, Dressback, a popular educator, would go from Vestavia Hills City school district darling to controversial figure after she came out as gay, divorced her husband, and began dating a Black woman.  

Within days of showing the custodian the photos, she was ordered to leave the building and was barred from district property. Soon, she found herself facing a litany of questions from district leaders about a seemingly minor issue: employee timesheets. In April, she was officially placed on administrative leave. On May 2, during a packed school board meeting, she was demoted, replaced as principal, and sent to run the district’s alternative high school. 

At that school board meeting, as he had for weeks, Todd Freeman, the superintendent, refused to offer an explanation, even to Dressback. Rather, at the beginning of the meeting, he read a statement that “we have not, cannot, and will not make personnel decisions based on an individual’s race, sex, sexual orientation, religion, national origin or disability.” (When contacted, Vestavia Hills City Schools spokesperson Whit McGhee said the district would not discuss confidential personnel matters and declined to make Freeman available for an interview. He provided links to school board meeting minutes, district policies and Alabama educator codes without explaining how they applied in Dressback’s case. Freeman and two other district officials involved in the situation did not respond to emails requesting interviews or a list of detailed questions.)

Despite Freeman’s assertion regarding personnel decisions, many people in the community believe differently. So many, in fact, that “the Dressback situation” has lit up social media (one TikTok post has more than 313,000 views), spurred supermarket conversations and online chatter — and challenged allegiances.  

“The entire situation has divided the community,” said Abbey Skipper, a parent at Cahaba Heights Elementary. Some people, she said, are “trying to label everyone who is on the side of Dressback as leftists or Democrats or radicals” and assuming “everyone who supports the superintendent and the board is a Republican — which isn’t true.”  

A private Facebook group, “We Stand With Lauren” quickly gathered 983 members, while a public Facebook post by a fifth grade teacher at Cahaba Heights complained of the “news frenzy and whirlwind of social media misinformation” and stated that, “We Stand for Our Superintendent, Our District Office, Our Board, and our new principal, Kim Polson.” The May 8 teacher post, which got 287 likes and 135 comments, both in support and challenging the post, went on to say, “To do our jobs to the best of our ability, we trust the people who have been charged to lead us.”

Alabama has among the strictest anti-gay policies in the nation. This past legislative session, the House passed a bill to ban LGBTQ+ flags and symbols from schools. It also expands to middle schools the current “Don’t Say Gay” law, which prohibits instruction or discussion of LGBTQ+ issues in elementary schools. Its sponsor, Rep. Mack Butler, who represents a suburban community in northeast Alabama, stated that it could “purify the schools just a little bit.” He later walked back the comment. The bill died in the Senate, but Butler has vowed to reintroduce it next session. 

The bill was one of dozens introduced or passed in states around the country restricting classroom discussion of gender identity, books with LGBTQ+ characters and displays of pride symbols. The laws have contributed to a climate in which “every classroom has been turned into a front” in a battle, said Melanie Willingham-Jaggers, executive director of GLSEN, which advocates for LGBTQ+ individuals in K-12 education. “Every educator, every administrator now has to be on that front line every single day,” she said. “We’re seeing educators leave because of the strain of the job made worse by the political moment we’re in and we’re also seeing because of the political moment we’re in, educators being targeted for their personal identity.” 

Tiffany Wright, a professor at Millersville University in Pennsylvania who studies the experience of LGBTQ+ educators, said right now many “are very on edge.”* Wright and her colleagues have surveyed LGBTQ+ educators four times since 2007, with new 2024 data to be released in November. While the past decade has seen strides toward acceptance, “the regional differences are huge,” she said. “Folks in the South definitely felt less safe being out to their communities and students.” November’s presidential and statewide elections could yield even sharper differences in LGBTQ+ protections between red and blue states.  

While quite a few states long had laws barring discrimination based on sexual orientation, it took a 2020 Supreme Court decision, Bostock v. Clayton County, to bring such protections to Alabama. That changed landscape spurred Dressback to engage lawyer Jon Goldfarb, who filed a complaint alleging work-based discrimination with the federal Equal Employment Opportunity Commission, which is investigating. This fall, he expects to file a separate federal civil rights complaint. In 30 years of practice in Alabama, Goldfarb said, “I’ve had a lot of people that have come to me and complain about being discriminated against because of their sexual orientation.” Until Bostock, he would tell them, “There is nothing we can do.” 

A review of Dressback’s personnel file shows no reprimands until June, when she received an evaluation questioning her professional conduct that followed her filing the EEOC complaint. This raises a question: Why was she removed?  

Dressback’s situation, however, is about more than the law. It also challenges her place in the white Christian, predominantly conservative community she grew up in, belongs to and loves. And it offers a test case in a divided political time: Will her removal and the outcry that followed harden partisan alignments — or shake them? Even in Alabama, a Pew Research Center survey shows, more than one-third of those who lean Republican say homosexuality should be accepted.

Brian DeMarco, a local attorney and high school classmate of Dressback’s, was sporting bright print swim trunks, a T-shirt and a Vestavia Hills baseball cap when we met at the public swimming pool where he’d brought his kids. We sat at a picnic table; the squeals of children released to the joys of summer carried in the warm Alabama air. He said he understands why some people may not be comfortable with a gay elementary school principal. 

“Her coming out as an educator, being around children, I think that frightens people, certain people all over the country,” he said. And in the South, in a conservative town, “it does become a bigger issue to people.” Politically, DeMarco tends “to swing right,” but sent Dressback a message of support on Facebook. “Everybody that knows Lauren  knows she is a good person,” he said. 

In fact, Dressback’s case has spurred public outrage because so many people do  know her. She attended Vestavia Hills Public Schools — Class of 1997 — and her mother, now retired, was a popular high school English teacher and yearbook adviser. She followed her parents into education (her father was a geography professor) and returned to teach social studies at the high school.  

In 2015, she was named secondary teacher of the year; in 2017, the graduating class dedicated the yearbook to her. She moved into administration and advanced; in 2022 she was appointed principal of Cahaba Heights Elementary School. She was awarded a three-year contract, effective July 2023, following a probationary year. In December — weeks before she was told to gather her things and was escorted off school grounds — she was given a positive write-up by an assistant superintendent who observed her running a meeting of teachers about the school’s “core values.” 

It also matters that this story is unfolding in Vestavia Hills. The city’s motto is “A Life Above,” and the municipal website declares that it “exemplifies the ideals of fine southern hospitality.” The community was born as a post-World War II subdivision and incorporated in 1950 with 3,000 residents (it now has 38,000). It is an effortfully attractive place with well-kept painted brick homes and clipped lawns. It is named for Vestavia, the exotic estate of former Birmingham Mayor George C. Ward whose Roman-inspired home was here. The 1930s-era news accounts describe lavish parties with male servers draped in togas. 

Vestavia Hills is also one of the “over the mountain” suburbs of Birmingham. When you drive over Red Mountain out of the urban core with its reminders of steelmaking and jazz, of Martin Luther King Jr. and the Negro Leagues, away from streets where shabbily dressed men push wheeled contrivances, where pride flags fly and breweries sprout, where drag queens coexist with affirming churches, you enter a different world. Birmingham is a Black city; Vestavia Hills is 86 percent white.

And like surrounding white suburbs of Mountain Brook, Homewood and Hoover, Vestavia Hills competes on lifestyle, including its public schools. Alabama is hardly an education leader, yet the four districts earn mention in U.S. News rankings. Church is also central to life here; biographies for public officials name which they attend.  

“You move a child into the school system, there’s two questions they’re asked,” Julianne Julian, a resident and another Dressback high school classmate, said when we met at a coveted rear table inside the Diplomat Deli, a popular Vestavia Hills lunch spot. “Who are you for as far as football — Alabama? Auburn? — and what church do you go to?” 

Teams matter in Vestavia Hills — the high school’s in particular. The district itself was founded in 1970 amid federal desegregation orders, when residents broke away from the Jefferson County Schools and agreed to pay an extra tax. They adopted the Rebel Man in Civil War military uniform as the district’s mascot. Dressback’s 1996 junior year high school yearbook includes a photo of students at a rally waving massive Confederate flags. “It was just kind of the way we were growing up,” said DeMarco, who in high school displayed a Confederate flag on his Nissan pickup. “It was just kind of cool.” 

It wasn’t until 2015 that the district considered changing the mascot. After contentious public meetings in which some argued that the mascot and flag were not racist — a point ridiculed by John Oliver on national television — the district chose to adopt the 1Rebel rebrand. (Mess with one Rebel and you mess with us all, is the concept. They are still called “The Rebels,” but simply use the letters “VH.”)

When I met with Dressback, days after school let out, she answered the door to her apartment wearing a T-shirt that read “love. empathy. compassion. inclusion. justice. kindness.” She looked like she could use every one of those things.  

She was welcoming, but said she was nervous about talking. She had not spoken publicly since she was escorted out of Cahaba Heights Elementary in February. We sat at her dining table — I brought an Italian sub, no onions or peppers, hot, from Diplomat Deli, Dressback’s regular order — and in our conversations then and later, she appeared to believe the best about people. 

Others in Vestavia clearly believe the best about her: Since things erupted, her phone has pinged with messages, including from former students. “Thank you for making an impact on my life,” said one of the many that she shared with me. “You stood up for me in class when someone made fun of me for having depression and I’ll never forget that,” wrote another. And, “you may not remember me, but I had you as a teacher during my time at VHHS and even when I was not your student, I still saw you as a person who cared for all students, not just the ones on your roster.” (Dressback said she has “not received any negative messages. Not one.”) 

At Cahaba Heights, parents noticed her gift for calming children with behavior issues. A mother of twins who got tripped up by transitions (drop-off is “the hardest part of our morning”) said that, with Dressback greeting them at the curb, “We didn’t have that struggle this year at all.” Sometimes Dressback would slip on a wig or costume — Santa, Minion, astronaut, among others; before winter breaks she donned an elf outfit and climbed atop the brick marquee in front of the school to the delight of arriving children and passing cars. She wanted to remind everyone that school is fun. 

“Her love for the children just reached every square inch of the school,” said Skipper, the Cahaba Heights parent of a second grader who moved to the neighborhood specifically for the school. Her removal “plunged me into grief. I couldn’t eat, I couldn’t sleep, I lost weight. The amount of upset was palpable. I loved her. She loved my child.” 

As we sat at her dining table, Dressback shared that she sensed she was gay in high school but said that “it sort of felt clear to me that I couldn’t have that life here.” The only gay people she knew well were two family members. When her Uncle Dennis died of complications from HIV and her cousin Robyn died by suicide, as upset as she was, being out was tough to imagine.  

The tragedies coincided with her time at Samford University, the private Baptist college where her father taught. “It’s one of the most religiously conservative schools in the nation,” she said. “You go to Samford to not be different.” And it was there in a geography class that she met Shane Dressback, when the two arrived early one day and “started chit-chatting.” They were engaged the next year, and married in January 2001, just after her December graduation. 

“I met Shane and did very genuinely fall in love with him,” she said. “He is a wonderful man.” They had two children —  Kaylee graduated from college in May and is playing semi-pro soccer, and Tyler is a senior in high school — and were consumed with family life. But then, as she approached becoming an empty nester, Dressback began having panic attacks around being gay, she said, feeling that “I’ve pushed this down for a really long time.”

This past December, she came out to Shane. They didn’t speak for more than 24 hours. Then, she texted him to say she was going to church. Minutes after the service began, she told me, “He texted me and said, ‘I’m here. May I come sit by you?’ So, we sat together at this church service. Both of us cried the whole way through it.” 

Shane Dressback told me that he struggled with the news. On one of his worst days, however, he said that God told him to love her “no matter what.” The next day, he told Lauren, “I was going to love her unconditionally and unconventionally.” The marriage ending was painful, but they remain close. “I know she loved me for 23 years,” he said. “There was nothing fake there.”  

The two held hands as they told their children and parents. They divorced, sold their home and rented apartments near one another. They still have family dinners and Shane cooks; leftovers of “Daddy’s Jambalaya” were in the refrigerator of Lauren Dressback’s apartment when I visited. Kaylee came by with her goldendoodle, Dixie, to grab a helping for lunch. 

Throughout Dressback’s ordeal with the school district, Shane has been her defender. “Lauren is a child of God and should be treated as such,” he said, as we sat at a friend’s brewery during off-hours. He knows her to be professionally excellent; her personal life should not matter. “It was no one’s business what was going on in our bedroom beforehand and I don’t think that’s anybody’s business now,” he said. “People have drawn a line in the sand where I think it needs to be more about, you know, loving people as Jesus did.” 

Shane was the one who urged Dressback to attend a brunch in early February organized by members of a LILLES Facebook group, which connects later-in-life lesbians. There she met her girlfriend, Angela Whitlock, a former medical operations officer in the U.S. Army and law student (she graduated in May). The two began a relationship that appears to charm and steady Dressback. At a dinner during my visit, they held hands under the table.  

Dressback says she came out to Freeman, the superintendent, at the end of a one-on-one meeting in January in the spirit of transparency. But the incident that appears central to Dressback’s removal unfolded just after Valentine’s Day, when Dressback asked Smith, the custodian, to come into the office of nurse Julie Corley, whom she described as a close friend at the time, and “close the door.”  

Dressback said it was Corley’s idea to show Smith the photos to see his reaction. He was in the lunchroom near Corley’s office. The brief exchange between Dressback and Smith was captured on video. (Dressback said she did not initially notice Corley filming, but did not stop her when she did, something she now regrets.) Corley did not respond to several interview requests by email and text, and, when reached by phone, said she was not interested in speaking and hung up. Dressback said she has not had any communication with Corley since being removed. 

“You shared something about your past, I was going to share something with you,” Dressback says to Smith in the video. “Do you want to see a picture of who I’m dating?” She and Whitlock had had their third date on Feb. 14. He says reflexively, “Shane?” She responds, “He’s my ex-husband.” Smith appears surprised. “April Fool?” and asks how long they were married. She says, “23 years.” He expresses disbelief. “You and him broke up?” Dressback holds out her phone to show a photo of her and Whitlock. 

“Who the hell is this? I mean, Who is this?” he asks. Several times Smith states that he doesn’t believe it. She hands him her phone. “Bullshit!” he exclaims as he looks at the three photos. “Stop lyin’!” There is one of Whitlock kissing Dressback on the cheek, one with their faces cheek to cheek and one in which they are sitting at a bar with Dressback’s arms around Whitlock, their noses touching. Smith then says, “Wow, I’m sorry,” and pulls her into a hug. “Once you go Black, baby, you don’t go back,” he quips. She groans at his attempt at humor.  

Dressback’s lawyer said that an affidavit the district obtained from Smith “appears to be in conflict on several points with what the video shows,” including a claim that he was made uncomfortable by the encounter. When reached by phone, Smith insisted, “I made no type of statement” even as district officials were “coming at me” seeking to query him, he said. “I hadn’t talked to nobody about the incident.”  

(McGhee, the school district spokesperson, declined to provide answers to specific questions, including regarding the apparent affidavit from Smith.)

Days after Dressback shared the photos, on the morning of Feb. 23, Meredith Hanson, the district’s director of personnel, and Aimee Rainey, the assistant superintendent who had given Dressback the positive write-up in December, arrived at Cahaba Heights for a surprise meeting. Dressback said they told her that someone had complained that she shared “explicit” details of her relationship at a meeting with teachers. Dressback knew that to be untrue. “I kind of relaxed because I was like, ‘Oh, yeah, that absolutely did not happen,’” she recalled. 

They questioned her in a way she found confusing. She asked for details of the complaint, but was told, “You know, ‘explicit.’ And I’m like, I know what ‘explicit’ means. Like are you going to tell me what they said I said or what?” They asked if she showed Smith photos of her and her girlfriend. She said she did. Meanwhile, she observed to me later, “There is a picture of Shane and me kissing on our lips at our wedding on the bookshelf right behind them.” (Hanson and Rainey did not respond to interview requests or to a list of detailed questions for this story.) 

Dressback says she was then told to gather her belongings, and that she was being placed on “detached duty,” requiring that she work from home. She was barred from school property. She was escorted from the building, which she said made her feel “like a criminal.” She expected to be gone for a few days.  

But several days later, Dressback was informed of a new problem: timesheets. In January, she had met with staff to remind them about clocking in and out (everyone must clock in, and paraprofessionals must clock out during lunch).  

On March 4, while still barred from the Cahaba Heights campus, Dressback met with Freeman, Rainey and Hanson in the conference room at the central office to discuss timesheets. Two days later, she was told that the following morning, March 7, she was to fire two employees for irregularities on their timesheets. One, she knew, had an attendance problem. She said that she had already discussed with Hanson not renewing him at the end of the school year.  

The other was a close friend, Stefanie Robinson, a paraprofessional who worked with students with severe disabilities, including those requiring help with feeding and diapering. Robinson often stayed in the classroom during her lunch breaks to aid the special education teacher because one student had as many as 30 seizures a day. When I met Robinson at her home, she acknowledged to sometimes forgetting to clock out or in, or not being able to do so if she was attending to a child’s needs. “If I’m in a massive diaper situation, I’m not going to remember to clock out, or if I’m helping a kid that’s having a seizure or, you know, one that’s in crisis,” Robinson told me.  

What most upset Robinson, however, was that shortly after Dressback was escorted out of the school and placed on “detached duty,” requiring she work from home, Robinson faced 45 minutes of questioning by Hanson and Rainey about Dressback’s dating life that she says “felt like an interrogation.” After confirming that she and Dressback were close, Robinson says she was asked questions such as, “When Lauren goes on a date, what does she say happens? And I was like, ‘What do you mean? What do you want to know?” They pressed: “Well, when she goes on a date and the date ends, what does she say happens after that?” Robinson insisted, “I don’t ask her how her date ended.”

On March 7 at 5:58 a.m., Robinson received a text from Hanson asking her “to start your day at the Board of Education” instead of Cahaba Heights. As soon as she arrived at the central office, she saw Dressback in the room; Dressback said Freeman had told her to fire Robinson. “I could tell she’d been crying,” said Robinson. “And I just smiled at her, I was like, ‘It’s OK.’” Robinson recalled Dressback saying, “in the most robotic tone, ‘It’s my recommendation to the board that your contract be terminated immediately.’” 

She hugged Dressback, told her she loved her, and left. Robinson texted the parent of one of her students, a second grade girl who is nonverbal, uses a wheelchair and has cerebral palsy and epilepsy. The girl’s mom, Payton Smith, no relation to Wesley, told me that she’d appreciated how Dressback had welcomed her child to the school a few years earlier. The principal had asked, “‘What do we need to do to make your kid feel comfortable?’ and recognized her as a child,” and not a set of legal educational requirements to meet, Smith recalled. Despite Robinson’s key role in her daughter’s education, Smith said she was not officially notified until March 19 — nearly two weeks later — via email that “Mrs. Robinson is no longer working at VHECH,” district shorthand for Cahaba Heights. 

Yet an email of district documentation shared with me states the date of Robinson’s leaving as April 5, and said that she had resigned. Nonetheless, the district continued to pay her for the rest of the school year, which she said felt “like I was being paid off because they knew what they did was wrong.” She is now a clinical research data coordinator for University of Alabama at Birmingham School of Medicine. (Neither McGhee, the district spokesperson, nor Hanson, in charge of HR, responded to email requests seeking comment on why Robinson was fired, the claim that she had resigned, or the discrepancy in her pay.)  

Meanwhile, on March 13, Dressback emailed Freeman asking to be reinstated to her position at Cahaba Heights, immediately. “I believe the action the system has taken against me is discrimination because of my sexual orientation, my interracial relationship, and my gender,” she wrote. The next day, Goldfarb, her lawyer, filed the EEOC complaint. (He later amended it to allege additional discrimination and that the district had retaliated against her for the filing.)  

On April 18, Dressback received a letter signed by Freeman officially placing her on administrative leave. It states that she is “not to contact any employees of the Vestavia Hills Board of Education related to your or their employment or relationship with the Vestavia Hills City Schools.” The letter does not state a reason for the action.

As a result, to parents and some educators, Dressback seemed to have vanished. “I thought like, ‘Oh, I bet she’s sick. That’s really sad,’” said Lindsay Morton, a Cahaba Heights parent, a reaction echoed by others. Then, on April 27, two of Dressback’s classmates from high school posted videos on social media.  

“Where is Principal Dressback???” a schoolmate and friend, Karl Julian, titled a video on his YouTube channel. It has been viewed more than 11,000 times. Lauren Pilleteri Reece, who as laurenpcrna has 228.7K followers on TikTok, posted several videos narrating Dressback’s battle; the first has more than 313,000 views and 3,400 comments. Reece has known Dressback since high school. 

When the Vestavia Hills School Board called a meeting five days later, on May 2, to take up Dressback’s employment, everyone seemed to know about it. People rallied outside the district headquarters holding posters with messages such as “We Stand with Principal Dressback” and “Love is Love.” Many people wore green, Dressback’s favorite color, to signal support. Local TV and news reporters showed up.  

The room thrummed with emotion. There were angry, even tearful Cahaba Heights Elementary parents, teachers and retired teachers, students, former classmates and others who knew Dressback, plus some who didn’t know her. “I’ve never met her, I just know she had been wronged,” said Jim Whisenhunt, an advertising executive whose children, now grown, attended Vestavia Hills public schools.  

Dressback, fearing that she could not keep her composure, did not attend. Those who did attend had a lot to share. But before public comments were permitted or a vote was taken, Freeman read the prepared statement in which he said he wanted “to address, in general, personnel decisions made by the board.” He went on to say that they “have not, cannot, and will not make personnel decisions based on an individual’s race, sex, sexual orientation, religion, national origin, or disability” and that “all of our decisions are vetted thoroughly and thoughtfully.” He added that “district employees contribute to academic excellence and are committed to our mission to provide every child in our schools the opportunity to learn without limits.” Then, over the objections of many in the audience who demanded a chance to comment before a vote was taken, the board officially transferred Dressback from Cahaba Heights Elementary to the alternative school.  

When public comments began, the outrage was obvious. “We may color outside of your lines a little bit, but coloring outside of your lines at no point does that ever mean that we are unprofessional. Lauren did not become unprofessional overnight,” said a charged-up Reece, who also came out as an adult. “You started looking at her as unprofessional overnight.”  

Rep. Neil Rafferty, a Democrat who represents Birmingham, stated that he “felt compelled to drive straight here” after “a long week in Montgomery” even though it is not his district. “We are all watching this. It is not just a Vestavia Hills issue anymore,” said Rafferty, the only openly gay member of the Alabama Legislature. The action, he said, signals “to your students who might be LGBTQ that they don’t matter.” 

Rev. Julie Conrady, minister of the Unitarian Universalist Churches of Birmingham and Tuscaloosa, and president of a local interfaith group, stood up to speak. “You are sending her a message that in Vestavia Hills it is not OK to be LGBTQ,” she told the board and superintendent. “You should not be punished in your job in 2024 because of who you love.” Conrady, in black liturgical robe and green stole, told the crowd “that there are consequences here for all these people. I want you to get pictures of every single name and vote them the hell out!” (The school board is appointed by the City Council, not elected.) 

Another speaker, Allison Black Cornelius, who said she was “a conservative Republican,” focused on what seemed to make this issue explode: the silence. The superintendent and board had given no explanation, even to Dressback, as to why she was removed and now demoted, she said. “When you wait this long,” said Cornelius, “it puts this person in this black cloud.” 

Her point underscored a question others raised at the meeting to a board that largely remained silent: If Dressback did something so egregious as to require she be escorted from school and barred from district property, why was she suitable to lead the alternative school? The district declined to answer this question. 

The division, so apparent at that meeting, seemed to only harden a few weeks later during the board’s annual meeting on May 28. A group supporting the board and superintendent appeared in blue T-shirts and applauded after the board gave Freeman a new four-year contract that included a raise to $239,500 (he was paid $190,000 when he was hired in 2018) plus perks. Dressback supporters in green again spoke, sharing their frustration.

This is not the first time Vestavia Hills City Schools have made unpopular personnel moves. In August 2020, Tyler Burgess, a well-loved bow-tied principal, was removed as head of the high school and assigned to oversee remote learning during Covid, when many classes were online; the board voted not to renew his contract in March 2021. Students organized a protest; 3,134 people signed a petition calling for his reinstatement. The board and superintendent did not provide an explanation for their decision. Burgess, who has a doctorate in education, is now director of learning and development at a large construction firm. He did not respond to multiple interview requests. 

Danielle Tinker came to Vestavia Hills after more than a dozen years in Birmingham and Jefferson County schools, first as assistant principal at Liberty Park Elementary. In spring 2021, she was selected as principal of Cahaba Heights. From the start, Tinker, who is Black, felt unwelcome at the school where the teaching staff was nearly all white, she told me when we met for lunch. The day she was introduced as the new principal, a staff member emailed her, saying that “Cahaba Heights is a family” and that “today was hard on this family,” according to a copy of the email that she shared with me. Tinker said she was told by staff that the faculty had wanted a different principal; a later inquiry confirmed that staff felt “blindsided” when she was selected over that individual. 

As principal, Tinker raised questions with Rainey, the assistant superintendent, over student articles in a fall 2021 newsletter, including two about race. They were titled “Anti-Racist Kids: Leading the Way to New Beginnings” and “Learning About Racism: How It Can Change Lives.” Tinker told me she feared those articles would be “more fluff than addressing the actual challenge” with claims such as “Racism is part of our lives, but it doesn’t have to be a bad thing if we are the ones ending it.” Rainey agreed to pause publication of the newsletter, which she said upset several teachers who wanted it published.  

On Dec. 16, 2021, several hours after Tinker told teachers that publication was being paused, Tinker emailed Hanson raising an “employee concern” after one of the teachers “stormed down the hallway” and was “pointing at me and yelling,” according to a copy of Tinker’s email exchanges that she shared with me. The next day, Tinker received a letter from Freeman stating that he was recommending she be transferred to the alternative school, effective Jan. 3. In March, Tinker filed a complaint of racial discrimination with the EEOC and resigned, using her remaining personal time to cover her pay for the remainder of the school year. In February 2023, she and the district reached a settlement for an undisclosed amount. She is using the money to attend law school. On my last day in town in early June, Dressback gave me a guided tour of Vestavia Hills. We met inside the Diplomat Deli; Reece, Dressback’s high school classmate with the large TikTok following, joined us. As we walked out, Dressback, wearing a Care Bears T-shirt, showed off a new tattoo on her left forearm. In typewriter font it reads, “Speak the truth, even if your voice shakes.” 

I slid into the passenger seat of her car, a red Buick Encore whose license plate reads “DBACK.” Reece hopped in back. An order of fries from Milo’s, a favorite Dressback fast-food spot since high school, leaned in a cup holder. Soon, we passed places they hung out as kids, schools they attended, new neighborhoods and old, the spot at Vestavia Country Club with a panoramic view where kids still take prom photos.  

The discussion jumbled together past and present, reminding these childhood friends — both of whom came out as adults — how much has changed. And how much has not. When we reached Vestavia Hills High School, Dressback stopped near a small sign at sidewalk level that reads “Alternative Placement” with an arrow. I descended metal stairs that span a rocky embankment; the alternative school, Dressback’s new assignment, is subterranean, its entrance nearly hidden from view. If architecture can relay shame, it might look like this. 

Yet when I returned to the car, Dressback told me she saw the alternative school as an opportunity rather than an exit. The school has often operated without a principal (Tinker never stepped inside or interacted with students, partly because of the Covid pandemic). At that late May school board meeting, Freeman could not say how many pupils attend the school. But Dressback was struck by what DeMarco, her classmate, told her. As a student, he spent time at the alternative school; he could have used someone like her. 

“I’m not gonna just go and sit and read a book. I can’t do that,” Dressback said, as she pulled out of the high school driveway. She wanted to make it a place less about punishment and more about connecting with kids for whom the traditional school is not a fit. It should not be a dumping ground for educators or for kids, she said. “My mindset is I’m gonna go and I’m gonna make this the best damn alternative school in the state.” 

In other words, Dressback is not willing to let go or to disappear. Yet “the Dressback situation” is hardly resolved. A few days after my visit, in early June, Dressback met with Freeman to receive an official performance review for the 2023-24 academic year, a copy of which she shared with me. It was the first official yearly evaluation she had been given in her career in the district despite a stipulation in her contract that this occur annually, she said. It is searing. It finds that her “job performance is unsatisfactory.” The report was sent to the state Department of Education, per Alabama code requiring that personnel records and “investigative information” of employees placed on administrative leave for cause be reviewed by the department. 

Most damning are six bullet points of claims. One alludes to Robinson’s employment and the timesheet matter. The most explosive is cast as “failure to demonstrate moderation, restraint, and civility in dealing with employees” and includes salacious assertions, including “public displays of affection and of photographs which would not, for example, be tolerated even among high school students” — presumably a reference to the photos shown to Smith, the custodian. It includes a charge Dressback had never heard before: a claim of “remote activation by your husband of a sexual toy on your person while you were in a school meeting.”

Dressback was floored by the charges, and countered each in her rebuttal, which she asked to have filed with the state Department of Education in response to Freeman’s report. Regarding the sex toy claim, Dressback wrote that it is “false. I have never done that, and I would never do that.” The very idea of “remote activation” of a sex toy by her husband was absurd, she said. “I wouldn’t think that I would need to remind you that my ex-husband and I are divorced, that I have recently come out as gay, and that I am now in a committed relationship with a woman,” she wrote. 

Such a thing never happened then, or in any school year, her rebuttal continued. She wrote that she “cannot imagine why you would credit this slanderous and irresponsible allegation” and include it in her personnel record, “other than to retaliate against me” for the EEOC filing.  

Her lawyer said in an email that the performance review “is further retaliation and an attempt to create further pretexts for the adverse employment actions the Board has already taken against her.”  

On Aug. 15, after the state Department of Education had reviewed the evaluation submitted by Freeman, the agency stated in a letter addressed to Dressback, cc’ing Freeman, that it had “examined information regarding an investigation in the Vestavia Hills City School System” and “decided to not take action against your Alabama Educator Certificate.” The same day, Freeman said in a letter to Dressback that she would “no longer be on administrative leave and may return to work” at the alternative school. 

It has been baffling and infuriating to some in the community as to how such charges surfaced so soon after Dressback was given a three-year contract extension last year.  The mystery that remains is why some people — people who were eager for her to continue leading the elementary school — now want her gone. The battle has been drawn up and is now readying to be fought. Dressback told me that beyond feeling driven to “defend my name and my integrity,” she wants to speak up for others who come after — or who are now silent.  

Of course, Dressback had hoped this could all be avoided. “I tried to just be the good employee,” she told me. “I thought if I just do what they ask me to do, this is gonna get wrapped up and I’ll go back to work” at Cahaba Heights.  

Notably, she still feels loyalty, even love, for Vestavia Hills and its school system.  

“Maybe I shouldn’t feel the allegiance I feel,” she said when we spoke over Zoom several weeks ago. “But I can’t just turn it off. It’s not like a water faucet. You know, it’s my home. It’s where I grew up and it’s where I chose to plant my career. As betrayed as I have felt, I just can’t turn my back on the system.” Rather, she wants to nudge it forward.

As students make their way back to college and campus demonstrations about the Israel-Hamas war resume, the central conflict isn’t likely to be student to student, but between the right to freedom of speech and the right to freedom from hostile environments. Whether it’s possible for both to exist on college campuses this fall remains to be seen.

Many colleges have strengthened their policies on how and when students can protest. Some say their “fear-based” approach has gone too far and will discourage students from exercising their First Amendment rights for fear of punishment. Others say they haven’t gone far enough, and recommend further action be taken both to prevent protest and to discipline students who participate.

The new policies — which have been issued at colleges including the University of PennsylvaniaIndiana University and Virginia Commonwealth University— often require students to register and receive prior approval for holding outdoor events or demonstrations; restrict how and when students can display posters and other materials on campus; limit where protests can be held and whether amplified sound is allowed to be used. Many are trying to prevent encampments, like those that proliferated last spring, entirely. 

Both the University of California and the California State University systems issued new policies this week banning encampments and “unauthorized structures,” or anything that blocks walkways or roadways on campuses.

Most of the new policy announcements begin by describing the institution’s dedication to academic freedom and freedom of speech, but Risa Lieberwitz, general counsel at the American Association of University Professors, said the new restrictions fundamentally undermine those freedoms.

Lieberwitz, who is also a professor of labor and employment law at Cornell University, worries that these restrictions will discourage students — especially those with minority viewpoints — from exercising their First Amendment rights for fear of surveillance by college leaders. Requiring students to register their protests ahead of time also prevents them from spontaneously assembling in the case of a sudden news event, Lieberwitz said. She said these restrictions will also make it easier for universities to punish students who participate in protests. 

“There comes a point where there’s so many restrictions that they’re no longer reasonable,” said Lindsie Rank, director of campus rights advocacy at the Foundation for Individual Rights and Expression, or FIRE. “They’re really there to discourage protest at all.”

Colleges should take this opportunity to help students understand how to exercise their First Amendment rights, Rank said, “so that these debates can continue but without the violence and vandalism and some of the stuff that we saw in the spring.” 

Last spring’s protests often escalated into occupation of campus buildings and dramatic clashes with university officials and police. The Associated Press reported that more than 3,000 people were arrested; many students were suspended, some were expelled and others temporarily lost access to their housing. Still others faced consequences related to their education, such as withholding of a diploma.

All the while, many Jewish and Muslim students have been harassed and have reported other negative experiences on campus since the protests began.

College leaders are under scrutiny for their handling of these protests. They’re receiving pressure from students, faculty, boards of trustees, donors and members of Congress, all of whom have competing interests. Three Ivy League presidents have resigned under pressure, with the third, Columbia’s Nemat Shafik, having stepped down last week.

Michael B. Poliakoff, the president and chief executive officer of the American Council of Trustees and Alumni, is among those who think college leaders haven’t done enough.

“We need courage in these difficult times, not convenience, not passivity,” Poliakoff said.

His group issued a guide to preventing encampments and occupations that says “the difference between peaceful protest and encampment is that the latter seeks to commandeer the public square of campus to the exclusion of all else in the community.”

The guide recommends requiring students to read the college’s code of conduct and sign a form “committing themselves to obey and honor” it, or risk “clear and severe” penalties, including suspension or expulsion without the possibility of having tuition refunded.

Poliakoff said colleges often come down hard on issues such as plagiarism and academic ethics, but are too lenient on others. 

“Disruption is an even greater offense against the spirit of the university, and it seems to be all too common. We need some much clearer focus on the kind of decorum, on the rules that protect everybody’s freedom,” he said. 

Quick Takes

College applicant numbers increased …

In a sign of hope for enrollment, the number of college applicants rose by 7 percent last year, continuing an upward trend of the past few years, according to a new report from the Common App. While applicant numbers don’t necessarily translate into enrollment numbers, and the Common App is used by only about one-third of four-year colleges in the country, the increases show a continued aspiration to earn a bachelor’s degree. (Some of the increase could be attributed to about 50 more colleges using the Common App, making a total of 1,074 colleges.)

Notably, applicants from families living in lower-income zip codes rose by 12 percent over the previous year, compared with 4 percent for their higher-income peers – the largest increase in the eight years the Common App has measured this. And public colleges saw a bigger increase of applicants –16 percent – than private colleges at 5 percent.

Applicants from underrepresented racial and ethnic groups increased by 11 percent from last year, continuing a trend from the past three years. American Indian and Native Alaskan applicants grew the most – 15 percent – followed by Latino and Black applicants at 12 percent and 10 percent respectively. Black applicants are now 14 percent of the total pool, mirroring the country’s population.

Student applicants who would be the first in their families to go to college also increased by 5 percent. Student applicants from rural areas rose by 9 percent, compared with 6 percent from large cities.

… while the number of colleges decreased

Meanwhile, the National Student Clearinghouse reports that the number of federally recognized colleges and universities — meaning institutions whose students are eligible for federal financial aid — fell 2 percent in the last academic year. This follows a long enrollment decline, spiraling institutional debt, falling revenue from tuition and the end of pandemic relief funding that was keeping many of those vulnerable schools alive. 

My colleague Jon Marcus first pointed out that colleges were closing this year at an average rate of one per week, in a story that examined what happens to students in these cases. And our Meredith Kolodner took an in-depth look at the case of Wells College, which closed abruptly, leaving students, faculty members and staffers in the dark until the last moment.

Education vaulted to the forefront of conversations about the presidential race when Democratic nominee Kamala Harris announced Tim Walz as her running mate. Walz, the governor of Minnesota, worked for roughly two decades in public schools, as a geography teacher and football coach. He has championed investments in public education: For example, in March 2023, he signed a bill to make school meals free to all students in public schools.

Harris, a former U.S. senator and attorney general in California, has less experience in education than her running mate. But her record suggests that she would back policies to make child care more affordable, protect immigrant and LGBTQ+ students and promote broader access to higher education through free community college and loan forgiveness. Like Walz, she has defended schools and teachers against Republican charges that they are “indoctrinating” young people; she has also spoken about her own experience of being bused in Berkeley, California, as part of a program to desegregate the city’s schools.

Harris and Walz have been endorsed by the country’s two largest teachers unions, the National Education Association and the American Federation of Teachers, which tend to support Democratic candidates.

Early childhood

Child care

Harris has been a vocal supporter of child care legislation during her time in the Biden administration, though the proposals have had a mixed record of success.

During the pandemic, the Biden administration provided $39 billion in child care aid to help keep programs afloat.


The administration lowered the cost of child care for some military families and supported raising pay for federally funded Head Start teachers to create parity with public school teachers.

Earlier this year, Harris announced a new federal rule that would reduce lower child care costs for low-income families that receive child care assistance through a federally funded program. That same rule also requires states to pay child care providers on a more reliable basis. In September, Harris highlighted affordable child care as a key issue on her campaign website and said she would ensure “that care workers are paid a living wage.” Harris also said she plans to cap child care costs at no more than 7 percent of a working family’s income, but did not elaborate on how that would be funded.

Walz has also supported child care programs as governor of Minnesota. Earlier this year, he announced a new $6 million child care grant program aimed at expanding child care capacity, which followed a 2023 grant program that cemented pandemic-era support so programs could increase wages for child care workers. — Jackie Mader

Family leave and tax benefits

As soon as she became the presumptive Democratic nominee in July, Harris reaffirmed her support for paid family leave, which also was part of the platform she proposed as a candidate in the 2020 Democratic presidential contest. Harris provided the tie-breaking Senate vote that temporarily increased the child tax credit during the pandemic and has proposed making that tax credit permanent.

In mid-August, Harris unveiled an economic policy agenda that proposes giving a $6,000 child tax credit for a year to families with newborns. She also wants to bring back and expand a pandemic-era child tax credit that lapsed in 2021. Harris’ proposal would provide up to $3,600 a year per child. 

Walz also was behind Minnesota’s child tax credit increase in 2023, and successfully pushed forward a statewide paid family and medical leave law that takes effect in 2026. — J.M.

Pre-K

In 2021, the Biden administration proposed a universal preschool program as part of a multi-trillion-dollar social spending plan called Build Back Better. The plan ultimately failed to win backing from the Senate.

Earlier this year, Walz signed a package of child-focused bills into law. one of which expands the state’s public pre-K program by 9,000 seats and provides pay for teachers who attend structured literacy training. — J.M.

K-12

Artificial intelligence, education technology, cybersecurity

Harris has played a key role in leading the Biden administration’s AI initiatives, particularly since the launch of ChatGPT. Biden signed an executive order on AI in October 2023, which directed the Education Department to develop within a year resources, policies and guidance on AI and to create an “AI toolkit” for schools.

While Harris hasn’t specifically addressed education technology, in the Biden administration, the Education Department earlier this year released the National Education Technology Plan to serve as a blueprint for schools on how to implement technology in education, how to address inequities in the use and design of ed tech and how to offer ways to bridge the country’s digital divide.

In 2023, the current administration announced several new initiatives to tackle cybersecurity threats in K-12 schools, including a three-year pilot program through the Federal Communications Commission that will provide up to $200 million to help school districts that are eligible for FCC’s E-Rate program cover the cost of cybersecurity services and equipment. — Javeria Salman

Immigrant students

Harris has vowed to protect those in the Deferred Action for Childhood Arrivals program, which delays deportation for undocumented immigrants brought to the United States as children. The Biden administration has also used its bully pulpit to remind states and school districts that all children regardless of immigration status have a constitutional right to a free public education. As a senator in 2018, Harris sponsored legislation designed to reunite migrant families separated at the U.S.-Mexico border by the Trump administration, although family separation has continued on a much smaller scale in the Biden administration. In Minnesota, Walz signed legislation that starting next year will provide free public college tuition to undocumented students from low-income families. — Neal Morton

LGBTQ+ students and Title IX

Harris and Walz have both expressed support for LGBTQ+ students and teachers. As a senator, Harris supported the Equality Act in 2019, which would have expanded protections in the Civil Rights Act on the basis of sexual orientation and gender identity in education, among other areas. In a speech to the American Federation of Teachers, Harris decried the so-called “Don’t Say Gay” laws passed by Florida and other states in recent years. Walz has a long history of supporting LGBTQ+ students in Minnesota, where he was the faculty adviser of Mankato West High School’s first Gay-Straight Alliance club in the 1990s. In 2021, Walz signed an executive order restricting insurance coverage for so-called conversion therapy for minors and directing a state agency to investigate potential “discriminatory practice related to conversion therapy.” Walz signed an executive order in 2023 protecting gender-affirming health care. Earlier this year, he signed a law barring libraries from banning books based on ideology; book bans nationwide have largely targeted LGTBQ+-themed books.

The Biden administration announced significant rule changes to Title IX in 2024 that undid some of the changes the Trump administration made, including removing a mandate for colleges to have live hearings and cross-examinations when investigating sexual assaults on campus. The current administration also expanded protections for students based on sexual orientation and gender identity, which had been temporarily blocked in more than two dozen states and in schools attended by children of members of Moms for Liberty, Young America’s Foundation and Female Athletes United. — Ariel Gilreath

Native students

As vice president, Harris worked in an administration that promised to improve education for Native Americans, including a 10-year plan to revitalize Native languages. The president’s infrastructure bill, passed in 2021, created a $3 billion program to broaden access to high-speed internet on tribal lands — a major barrier for students trying to learn at home during the pandemic. During his time as governor, Walz signed legislation last year to make college tuition-free for Native American students in Minnesota and required K-12 teachers to complete training on Native American history. Walz also required every state agency, including the department of education, to appoint tribal-state liaisons and formally consult with tribal governments.

Walz spent part of his early career teaching in small rural schools, including on the Pine Ridge Indian Reservation in South Dakota. — N.M.

School choice

Harris, who was endorsed by the nation’s largest public school teachers unions, has voiced support for public schools, but has said little about school vouchers or school choice. Walz does not support private-school vouchers, opposing statewide private-school voucher legislation introduced in 2021 by Republicans in Minnesota. — A.G.

School meals

One of Walz’s signature legislative achievements was supporting a bill that provides free school breakfasts and lunches to public and charter school students in Minnesota, regardless of household income. Walz, who signed the law in 2023, made Minnesota one of only eight states to have a universal school meal policy. The new law is expected to cost about $480 million over the next two years.

The Biden administration also expanded access to free school lunch by making it easier for schools to provide food without collecting eligibility information on every child’s family. — Christina A. Samuels

School prayer

The Biden administration has sought to protect students from feeling pressured into praying in schools. Following the 2022 Supreme Court decision in Kennedy v. Bremerton, the federal Education Department published updated guidance saying that while the Constitution permits school employees to pray during the workday, they may not “compel, coerce, persuade, or encourage students to join in the employee’s prayer or other religious activity.” — Caroline Preston

Special education

As a candidate for the Democratic presidential nomination, Harris released a “children’s agenda” in 2019 that, among other provisions, called for a large boost in special education spending.

When Congress first passed the federal law that is now called the Individuals with Disabilities Education Act, it authorized spending to cover up to 40 percent of the “excess costs” of educating students with disabilities compared to their peers. But Congress has never come close to meeting that goal, and today the federal government distributes only about 15 percent of the total cost of educating students with disabilities. The shortfall is “immoral,” Harris told members of the National Education Association at a 2019 candidates forum.

The Biden administration also has proposed large increases in special education spending, but proposals for full funding of special education have not made it through Congress.

In 2023, the Minnesota Department of Education created a grant program to help school districts “grow their own” special education teachers. The first round of funding awarded $20 million to 25 grantees. In August, a second round of funding provided nearly $10 million to benefit more than 35 districts and charter schools. — C.A.S.

Student mental health, school safety

As California attorney general, Harris created a Bureau of Children’s Justice to address childhood trauma, among other issues. She has spoken out about the mental health toll of trauma, including from poverty, and the need for more resources and “culturally competent” mental health providers. But a 2011 law she pushed for as attorney general allowing parents of chronically absent students to be criminally charged later drew criticism for its toll on families, particularly those who are Black or Hispanic. Harris has said she regrets the law’s “unintended consequences.”

The Biden administration’s actions on student mental health includes expanding the pipeline of school psychologists, streamlining payment and delivery of school mental health services and directing the Centers for Disease Control and Prevention to develop new ways of assessing social media’s impact on youth mental health.

As vice president, Harris leads the new White House Office of Gun Violence Prevention, which was created after lobbying by survivors of school shootings to support gun safety regulations. She has touted the administration’s efforts to prevent school shootings, including a grant program that has awarded roughly $500 million to schools for “evidence-based solutions,” including anonymous reporting systems for threats and training for school employees on preventing school violence. 

In Minnesota, Walz’s 2022 budget called for $210 million in spending to help schools support students experiencing mental health challenges. “As a former classroom teacher, I know that students carry everything that happens outside the classroom into the classroom every day, and this is why it is imperative that our students get the resources they deserve,” he said. — C.P.

Teachers unions, pandemic recovery

The Biden administration has close ties to the nations’ largest teachers unions, the American Federation of Teachers and the National Education Association, the latter of which is the largest labor union of any kind in the country. First lady Jill Biden, who teaches community college courses, is a member of the NEA. Walz, a former teacher, is also an NEA member.

The administration was criticized for discussing with the AFT what kinds of safety measures should accompany the reopening of public schools after the pandemic.

Since 2021, the Biden administration has poured billions into helping public schools recover from the pandemic in various ways: to pay for more staff and tutors and upgrade facilities to improve air conditioning and ventilation, among other things. However, academic performance has yet to rebound, and the recovery has been uneven, with wealthier white students more likely to have made up ground lost during remote classes and Black and Latino students less likely to have done so.

The two unions, which had supported reelecting Biden, quickly threw their support to Harris and Walz. “Educators are fired up and united to get out and elect the Harris-Walz ticket,” NEA President Becky Pringle said after Harris named Walz as her running mate. “We know we can count on a continued and real partnership to expand access to free school meals for students, invest in student mental health, ensure no educator has to carry the weight of crushing student debt and do everything possible to keep our communities and schools safe.” — Nirvi Shah

Teaching about U.S. history and race

Both Harris and Walz have pushed back against Republican-led attacks on K-12 history instruction and efforts to minimize classroom conversations around slavery and race. Shortly after taking office in January 2021, the Biden administration dissolved President Donald Trump’s 1776 commission. In July 2023, Harris criticized a new history standard in Florida that said the experience of being enslaved had given people skills “for their personal benefit.”

As governor, Walz released an education plan calling for more “inclusive” instruction that is “reflective of students of color and Indigenous students.” It also called for anti-bias training for school staff, the establishment of an Equity, Diversity and Inclusion center at the Minnesota Department of Education, and the expansion of efforts to recruit Indigenous teachers and teachers of color. Walz also has advocated for educating students about the Holocaust and other genocides; state bans on teaching about “divisive concepts” in some Republican-led states have chilled such instruction. — C.P.

Title I

Harris’ 2019 “children’s agenda,” from when she was angling to be the Democratic nominee for president, proposed “significantly increasing” Title I, the federal program aimed at educating children from low-income families. The Biden administration also has proposed major increases to Title I spending, but Congress has not enacted those proposals. — C.A.S.

Stories that inspire

Higher Education

Accreditation

As California attorney general, Harris urged the federal government in 2016 to revoke federal recognition for the accrediting agency of the for-profit chain Corinthian Colleges, which she had successfully sued for misleading students and using predatory recruiting practices. The accreditor’s recognition ultimately was removed in 2022. 

As vice president, Harris has said little about the accreditation system, which is independently run and federally regulated and acts as a gatekeeper to billions of dollars in federal student aid. But the Biden administration has sought to require accreditors to create minimum standards on student outcomes such as graduation rates and licensure-exam pass rates. Sarah Butrymowicz

Affirmative action

Harris has long supported affirmative action in college admissions. As California attorney general, she criticized the impact of the state’s 1996 ban at its public colleges. She also filed friend-of-the-court briefs in support of the University of Texas’ race-conscious admissions policy when the Supreme Court heard challenges to it in 2012 and 2015.

Last June, Harris criticized the Supreme Court’s ruling against affirmative action the same day it was handed down, calling the decision a “denial of opportunity.” Walz, referring to the decision, wrote on X, “In Minnesota, we know that diversity in our schools and businesses reflects a strong and diverse state.” — Meredith Kolodner

DEI

Harris has not shied away from supporting DEI initiatives, even as they became a focus of attack for Republicans. “Extremist so-called leaders are trying to erase America’s history and dare suggest that studying and prioritizing diversity, equity, and inclusion is a bad thing. They’re wrong,” she wrote on X.

As governor, Walz has taken steps to increase access to higher education across racial groups, including offering tuition-free enrollment at state colleges for residents who are members of a tribal nation. This spring, Walz signed a budget that increased funding for scholarships for students from underrepresented racial groups to teach in Minnesota schools. — M.K.

For-profit colleges

Harris has long been a critic of for-profit colleges. In 2013, as California state attorney general, she sued Corinthian Colleges, Inc., eventually obtaining a more than $1.1 billion settlement against the defunct company. “For years, Corinthian profited off the backs of poor people now they have to pay,” she said in a press release. As senator, she signed a letter in the summer of 2020 calling for the exclusion of for-profit colleges from Covid-era emergency funding. — M.K.

Free college

The Biden administration repeatedly has proposed making community college free for students regardless of family income. The administration also proposed making college free for students whose families make less than $125,000 per year if the students attend a historically Black college, tribal college or another minority-serving institution.

In 2023, Walz signed a bill that made two- and four-year public colleges in Minnesota free for students whose families make less than $80,000 per year. The North Star Promise Program works by paying the remaining tuition after scholarships and grants have been applied, so that students don’t have to take out loans to pay for school. — Olivia Sanchez

Free/hate speech

Following nationwide campus protests against the war in Gaza, Biden said, “There should be no place on any campus, no place in America for antisemitism or threats of violence against Jewish students. There is no place for hate speech or violence of any kind, where it’s antisemitism, Islamophobia, or discrimination against Arab Americans or Palestinian Americans.” His Education Department is investigating dozens of complaints about antisemitism and Islamophobia on K-12 and college campuses, a number that has spiraled since the start of the war. Pell grants

The Pell grant individual maximum award has increased by $900 to $7,395 since the beginning of the Biden administration, part of its goal to double the maximum award by 2029. Education experts say that when the Pell grant program began in the 1970s, it covered roughly 75 percent of the average tuition bill but today covers only about one-third. They say doubling the Pell grant would make it easier for low-income students to earn a degree. The administration tried several times to make Pell grants available to undocumented students who are part of the Deferred Action for Childhood Arrivals program, but has been unsuccessful. — O.S.

Student loan forgiveness

In 2019, while campaigning for the Democratic presidential nomination, Harris proposed forgiving loans for Pell grant recipients who operated businesses in disadvantaged communities for a minimum of three years. As vice president, she was reportedly instrumental in pushing Biden to announce a sweeping debt cancelation policy.

The policy, which would have eliminated up to $20,000 in debt for borrowers under a certain income level, ultimately was blocked by the Supreme Court. Since then, the Biden administration has used other existing programs, including Public Service Loan Forgiveness, to cancel more than $168 billion in federal student debt.

Harris has regularly championed these moves. In April, for instance, she participated in a round-table discussion on debt relief, touting what the administration had done. “That’s more money in their pocket to pay for things like child care, more money in their pocket to get through the month in terms of rent or a mortgage,” she said of those who had loans forgiven.

But challenges remain. In August, a federal appeals court issued a stay on a Biden plan, known as the SAVE plan, which aimed to allow enrolled borrowers to cut their monthly payments and have their debts forgiven more quickly than they currently can. — S.B.

Workforce development

Last fall, the Biden administration sent nearly $94 million in grant funding to job training programs, including community colleges and programs that partner with high schools. Earlier this year, the administration also announced $25 million for a new Career Connected High Schools grants program to help establish pathways to careers. In addition, the administration invested billions in nine workforce training hubs across the country. 

The Democratic Party platform unveiled at the national convention in Chicago also mentions expanding career and technical education. “Four year college is not the only pathway to a good career, so Democrats are investing in other forms of education as well,” the platform says.

Walz’s education plan as governor of Minnesota also set a goal of increasing career and technical education pathways. In October 2023, he signed an executive order eliminating college degree requirements for most government jobs in the state, a growing trend in states looking to expand alternative pathways to careers. — A.G.

Republican presidential candidate Donald Trump and his running mate, JD Vance, are persistent critics of public K-12 schools and higher education and want to overhaul many aspects of how the institutions operate. On the campaign trail, Trump has repeatedly called for the elimination of the federal Education Department, arguing that states should have full authority for educating children. (Abolishing the department has been a long-standing goal of many Republicans, but it’s highly unlikely to win enough support in Congress to happen.)

Trump also supports efforts to privatize the K-12 school system, including through vouchers for private schools. Both he and Vance have launched repeated attacks on both K-12 and higher education institutions over practices that seek to advance racial diversity and tolerance and policies that provide protections to transgender students, among other issues. The candidates have also argued that higher ed institutions suppress the free speech of conservative students; as president, Trump took at least one action to tie funding to free speech protections. 

“Rather than indoctrinating young people with inappropriate racial, sexual, and political material, which is what we’re doing now, our schools must be totally refocused to prepare our children to succeed in the world of work,” Trump said in a September 2023 video describing his education proposals.

Early childhood

Child care

Even though Trump launched his first campaign for president with a child care policy proposal to expand access to care through tax code changes, child care largely took a back seat during his presidency. That said, there were some notable actions: Before the pandemic, Trump signed a tax law that increased the child tax credit from $1,000 to $2,000 per child, although research found higher-income families benefited significantly more from the change than low-income families. In 2018 he proposed cuts to the Child Care and Development Block Grant, a federal program that helps low-income families pay for child care, but ultimately approved funding increases passed by Congress in both 2018 and 2020.

In 2020, in the early days of the pandemic, Trump signed the Coronavirus Aid, Relief, and Economic Security, or CARES, Act, which allotted an additional $3.5 billion for the Child Care and Development Block Grant. The supplemental fund was also meant to support the child care needs of essential workers. The CARES Act also provided supplemental funding to Head Start. —Jackie Mader

Family leave and tax credits

Also in 2020, Trump supported a bipartisan paid family leave bill, although it was more limited in scope and benefits than other paid leave proposals. Trump’s 2021 budget proposal called for eliminating the federal Preschool Development Grant program and decreased funding for a federal program that helps low-income college students pay for child care.

Vance has focused on legislation that encourages and supports parents to stay at home with their young children. In 2023, he co-sponsored a bill that would prevent employers from clawing back health care premiums the employers paid during a parent’s time off under the Family and Medical Leave Act if the parent chose not to return to work. He has been a vocal opponent of universal child care and instead has expressed support for more tax credits for parents. In mid-August, Vance expressed support for a $5,000 per child tax credit, an increase from the current maximum of $2,000 per child.— J.M.— J.M.

K-12

Artificial intelligence

In 2019, Trump signed an executive order directing federal agencies to focus on research and development around AI, and a year later his administration announced that $140 million would be awarded to several National Science Foundation-led programs to conduct research on AI at universities nationwide.

On the campaign trail this year, however, Trump said he will reverse the executive order on artificial intelligence signed by Biden last October, calling it a hindrance to AI innovation. Both Trump and his running mate, Vance, have disagreed with the Biden administration on what AI regulations should look like. While education leaders have called for regulations and guardrails around AI use and development, Vance has called for less regulation. — Javeria Salman

Immigrant, Native and rural students

The Republican presidential ticket and official party platform espouse anti-immigrant positions, advocating for mass deportations of anyone who entered the country without legal documentation. The Heritage Foundation, a conservative think tank behind Project 2025, earlier this year released a set of policy recommendations on undocumented immigrants in U.S. public schools that would directly challenge a long-standing Supreme Court decision requiring states to provide a free education to all students regardless of their immigration status. While Trump has tried to distance himself from Heritage and its policy proposals, his running mate wrote the forward to an upcoming book from Project 2025’s former leader and many former Trump administration officials were involved in crafting the plan.

With respect to Native students, Trump as president released a “Putting America’s First Peoples First” brief outlining his promises to Indian Country, including access to college scholarships for Native American students, creating new tribally operated charter schools and improving the beleaguered agency that oversees K-12 education on reservations. Trump also pitched a 25 percent boost in funding for Native language instruction.

Vance, in an interview before Trump took office in 2017, encouraged the new administration to focus on education as a tool to help struggling rural communities. He said increasing options for students after high school would prepare them for jobs in a “knowledge economy” and give them more choices beyond pursuing a minimum-wage service sector job or going to a four-year college. “There’s no options in between and consequently people don’t see much opportunity,” Vance said. — Neal Morton

LGBTQ+ students and Title IX

In 2017, Trump rolled back Obama-era guidance that offered protections for transgender students to use school bathrooms based on their gender identity. His campaign website says he plans to reverse any gender-affirming care policies implemented by President Joe Biden, who  signed an executive order in 2022 encouraging the Departments of Education and of Health and Human Services to expand access to health care and gender-affirming care for LGBTQ+ students. He has also warned schools that, if reelected, he would cut or eliminate federal funding if teachers or school employees suggest “to a child that they could be trapped in the wrong body.” Vance sponsored a Senate bill last year that would ban medical gender-affirming care for minors, but it has not advanced.

The Trump administration significantly changed how colleges handle sexual assault allegations through Title IX during his time in office, adding a requirement for colleges to conduct live disciplinary hearings and allow cross-examinations in sexual assault cases; this was largely undone by the Biden administration. Trump said he plans to roll back Title IX rules the Biden administration implemented that expanded protections against discrimination on the basis of gender identity and sexual orientation. Trump has also said he would prevent transgender athletes from participating in sports teams based on their gender identity; school rules on this issue are now decided at the state- or school-level with a Biden administration proposal stalled. — Ariel Gilreath

School choice

Expanding school choice through private-school vouchers has been a key part of Trump’s education policy, but he had little success in getting his most ambitious efforts passed by Congress. One early accomplishment came via the Tax Cuts and Jobs Act of 2017. His administration made it possible for parents to use their children’s 529 college savings plan to pay for up to $10,000 annually in private school tuition.

His education secretary, Betsy DeVos, a longtime school-choice supporter in her home state of Michigan, made several high-profile attempts to support charter schools and expand private- school voucher expansion. DeVos attempted to set aside $400 million for charter schools and private-school vouchers in the 2018 federal budget, and in 2019, she promoted a $5 billion tax credit program for private-school vouchers, but neither proposal cleared Congress. During a speech in June 2020, Trump called school choice the “civil rights statement of the year.” Later that year, after widespread school closures, Trump issued an executive order allowing states to use money from a federal poverty program to help low-income families pay for private schooling, homeschooling, special education services or tutoring. His campaign website says he supports state and federal level universal school choice, and it highlights programs in Arizona, Arkansas, Florida, Iowa, Ohio, Oklahoma, Utah and West Virginia. — A.G.

School meals

The Trump administration made several attempts to roll back lunch nutrition standards that had been championed by Michelle Obama, arguing that schools needed more flexibility and the standards were leading to wasted food.

However, in 2020, a federal judge ended the Trump administration’s efforts to ease requirements for whole grains and to allow more sodium in school meals, among other changes. The administration did not follow proper procedures in easing those nutrition mandates, the court ruled. — Christina A. Samuels

School prayer

Trump has been an advocate for what his campaign calls “the fundamental right to pray in school.” As president, he issued guidance intended to protect students who want to pray or worship in school. The outcome of Kennedy v. Bremerton, the 2022 Supreme Court ruling that a football coach had a constitutional right to pray on the field after games, was shaped by the three justices that Trump appointed to the court. Some nonprofit and legal groups have criticized Trump’s positions, arguing that he muddies the separation of church and state and that the real problem is not suppression of religious freedom in schools but children who feel pressured into religious expression. — Caroline Preston

School safety, student mental health

When it comes to school safety, Trump has supported policies that prioritize the “hardening” of schools and strict disciplinary approaches. According to his 2024 campaign website, if reelected, Trump would “completely overhaul federal standards on school discipline to get out-of-control troublemakers OUT of the classroom and INTO reform schools and corrections facilities.” He would also support schools that allow “highly trained teachers” to carry concealed weapons in classrooms and hire veterans and others as armed guards at schools. Regarding youth mental health, his campaign says he would direct the U.S. Food and Drug Administration to investigate the effects of “common psychiatric drugs” and gender-affirming hormone therapy on young people.  

Vance has taken similar positions. During his 2022 Senate run, he said he supported Ohio’s new law that lowered the amount of training required for teachers to carry concealed weapons in classrooms. In Congress, he raised concerns about elements of the Bipartisan Safer Communities Act, the gun safety law passed in 2022 after the mass shooting at an elementary school in Uvalde, Texas, and co-sponsored two bills that would have altered language in the bill to permit schools to buy weapons for use in archery, hunting and sharp-shooting programs. (A similar bill introduced in the House ultimately passed.) Vance also sponsored a bill that would direct the education secretary to study the use of mobile devices in K-12 schools — a mental health concern — and establish a pilot program to support schools’ efforts to become device-free. — C.P.

Special education

The Trump administration attempted to roll back a rule that requires districts to track students in special education by race and ethnicity in order to determine if minority students are more likely to be identified for special education, face harsher discipline, or be placed in classrooms separate from their general-education peers. A judge dismissed the administration’s efforts to eliminate this policy on procedural grounds. — C.A.S.

Teachers unions, pandemic recovery

Teachers unions, unlike some other labor groups, did not work well with the Trump administration and do not back the Trump/Vance ticket. Trump’s 2024 platform advocates undercutting some of the protections teachers unions support. It says, “Republicans will support schools that focus on Excellence and Parental Rights. We will support ending Teacher Tenure, adopting Merit pay, and allowing various publicly supported Educational models.”

His administration pushed schools to reopen ahead of the 2020-21 school year but without the kinds of safeguards Randi Weingarten, president of the American Federation of Teachers, said were essential to get teachers and kids back together, in person. Trump signed two broad relief packages passed by Congress in 2020 that included more than $100 billion in aid for K-12 schools to recover from the pandemic. — Nirvi Shah

Teaching about U.S. history and race

Both Trump and Vance have attacked critical race theory and advanced concerns that K-12 teachers are stirring anti-white bias among students. As president, Trump criticized the 1619 Project, a New York Times history document arguing that the enslavement of Black Americans was central to U.S. history. He established the President’s Advisory 1776 Commission as a rebuke to the project; its January 2021 report called for “restoring patriotic education” and railed against “identity politics.” The Biden administration rescinded the commission, but Trump has pledged to reinstate it if reelected.

Vance, meanwhile, made education culture war issues central to his 2022 run for Senate. On his campaign website, he pledged to cut funding for state universities in Ohio that teach critical race theory and “to force our schools to give an honest, patriotic account of American history.” — C.P.

Title I

During each of his four years in office, Trump submitted budget proposals that would have consolidated more than two dozen programs, including Title I, the largest source of federal funding for schools. The program is intended to support services at schools that educate children from low-income families. Congress rejected the administration’s efforts to consolidate the programs — C.A.S.

Higher education

Accreditation

The Trump campaign has gone after college accrediting agencies, which serve as the gatekeepers for billions of dollars in federal student aid, claiming that the entities are part of the “radical Left” and have “allowed our colleges to become dominated by Marxist Maniacs and lunatics.” (The fact that some accrediting agencies have added or considered standards related to diversity, equity and inclusion also has drawn ire from many on the right.)

In a video posted to his campaign site, Trump pledges to “fire” existing accrediting agencies. The government does have regulations that these entities must follow, but revoking their recognition would require a lengthy Education Department review.

Trump goes on to say that he would open applications for new accreditors to impose standards that include “defending the American tradition and Western civilization, protecting free speech, eliminating wasteful administrative positions that drive up costs incredibly,” and “implementing college entrance and exit exams to prove that students are actually learning and getting their money’s worth.” Sarah Butrymowicz

Affirmative action

Both Trump and Vance have taken a hard stance against affirmative action and diversity initiatives. Trump celebrated the Supreme Court’s 2023 ruling banning affirmative action in college admissions, calling it a “great day for America.” “We’re going back to all merit-based — and that’s the way it should be,” he wrote on TruthSocial.

Following that decision, Vance wrote a letter to college presidents warning, “The United States Senate is prepared to use its full investigative powers to uncover circumvention, covert or otherwise, of the Supreme Court’s ruling.” Last December, he introduced a bill to create an inspector general’s office to investigate discrimination in college admissions and financial aid, which would take federal aid away from colleges found in violation. — Meredith Kolodner

Community college

Trump has said people don’t understand what community colleges are and suggested they be renamed vocational or technical colleges (though they are not the same thing). He has not supported tuition-free community college, but last year, he pitched the idea of a free online college he called American Academy, be paid for by taxes on private universities. Experts have said this plan is unlikely to take hold. — Olivia Sanchez

DEI

As the agitation about DEI initiatives intensified in 2020, Trump issued an executive order that banned diversity training that was “divisive,” which applied to federal agencies and recipients of federal grants, including universities.

Vance has also criticized DEI initiatives, calling them “racism, plain and simple.” Last December, he wrote a letter to the president of Ohio State University, probing its hiring practices and its curriculum. “If universities keep pushing racial hatred, euphemistically called DEI, we need to look at their funding,” he wrote on X. — M.K.

For-profit colleges and universities

Trump has long been seen as a friend of the for-profit college sector. Before he became president, he ran the for-profit Trump University, which trained students for careers in real estate. He was subsequently sued by former students who claimed the college had misled them; the case was settled with a $25 million payout. While in office, he took several steps to make it easier for for-profit colleges to thrive, and enrollment at those institutions began to rise in 2020. His administration rolled back the Obama-era gainful employment rule, which required for-profit colleges to meet certain benchmarks to ensure that a majority of graduates were making enough to pay back their loans. As president, Trump vetoed a bill that would have provided debt forgiveness to veterans defrauded by for-profit colleges.— M.K.

Free/hate speech

Trump considers himself an advocate of free speech, but he has attacked the speech of others and drawn criticism for comments about immigrants and other groups that some argue amount to hate speech.

In 2019, Trump signed an executive order requiring that colleges and universities commit to promoting free speech and free inquiry to continue receiving research funding from 12 federal agencies. He said this was to protect conservative students from being silenced and discriminated against. “Under the guise of ‘speech codes’ and ‘safe spaces’ and ‘trigger warnings,’ these universities have tried to restrict free thought, impose total conformity, and shut down the voices of great young Americans like those here today,” he said when signing the order.

Vance also has argued that conservative students are being silenced on college campuses. When he was running for Senate, Vance gave a speech entitled “Universities are the enemy” in 2021, calling the institutions corrupt and arguing they disseminate lies rather than truth and knowledge.

In the same speech, he called his alma mater, Yale University Law School, “clearly a liberal-biased place” at the time he graduated in 2013, adding that when he returned five years later to promote his book, “it felt totally totalitarian.” “It felt like the sort of place where if you were a conservative student who had conservative ideas you were terrified to utter them,” Vance said. — O.S.

Pell grants

The Trump administration proposed cutting the Pell grant surplus fund twice, including a proposed $3.9 billion diversion that would have funded several unrelated initiatives, including a NASA plan to take astronauts back to the moon. Though dipping into the Pell reserves wouldn’t have affected students already awarded Pell grants, education advocates argued that it would have imperiled funding for future students. None of these proposals were approved by Congress. A Trump plan to allow students to use Pell grants on short-term programs was unsuccessful.

Trump proposed formalizing an Obama-era pilot program that made incarcerated people eligible for Pell grants. Congress approved this expansion in the FAFSA Simplification Act passed in December 2020. — O.S.

Student loan forgiveness

As president, Trump proposed eliminating the Public Service Loan Forgiveness program, which wipes out loan debt for people who work in the public sector or nonprofits. During his tenure, the Department of Education also stopped enforcing a regulation that provided an avenue for debt relief to students who had been defrauded by their colleges.

Trump praised the three justices he appointed to the Supreme Court for their votes to strike down Biden’s broad debt forgiveness plan. He has attacked the Biden administration’s continued efforts to cancel debt as “vile” and “not even legal.”

Vance has taken a similar stance on large-scale loan forgiveness, saying on X, formerly known as Twitter, that “Forgiving student debt is a massive windfall to the rich, to the college educated, and most of all to the corrupt university administrators of America.” But he did co-sponsor a bipartisan bill earlier this year that would allow parents to get loans discharged if their child became permanently disabled. — S.B.

Workforce development

Federal funding for career and technical education, which had been stagnant for more than a decade before Trump came into office, rose significantly during his administration. In 2018, Trump renewed the Carl D. Perkins Career and Technical Education Act — one of states’ primary sources of federal funding for CTE programs – and reduced regulations on how states are required to spend the money. In 2020, he proposed one of the largest-ever increases in funding for career and technical education, even as he sought to cut the overall budget for the Department of Education. 

Trump also established an advisory council tasked with developing a national strategy to train people for high-demand jobs. His campaign website says he plans to provide “funding preferences” for schools that help students find internships and jobs and for schools that have career counselors for students. His website also highlights the Cristo Rey Network — a group of Catholic schools across the country where students are required to work at part-time, entry-level jobs one day a week during the school year throughout high school. — A.G.

It was the start of my sophomore year at a new public high school in New York City. With its dark brick exterior and barbed wire on the roof, my school already resembled a small prison — and staff had just installed several metal detectors at the front entrance.

As my classmates begrudgingly walked through security in packed lines stretching out to the street, I asked why. One of the administrators said, “Because it will keep everyone safe.”

This was a majority-Black high school, and I knew what that meant: We, the students, were perceived to be a threat — and we were being punished for something we didn’t do.

Situations like this are the reality for too many students across the United States. Black middle and high school students are over three times more likely than white students to attend a school with more security staff than mental health personnel. And data has consistently shown disparities in school discipline practices. Black students, for example, are 2.2 times more likely to be referred for disciplinary action than white students for school-related incidents.

Meanwhile, the rising number of school shootings in our country has sparked an intense debate on how to best keep students safe. There’s a big push for more police in schools right now to provide an illusion of safety.

In my view, more law enforcement is not the answer. School safety doesn’t require more policing. Instead, schools need more structured support, such as access to mental health and counseling resources.

Increased police presence in schools is intended both to prevent and to disrupt active violence. But it can be woefully ineffective, as was the case during the Uvalde school shootings, when police not only delayed their response but also failed to adhere to safety protocols. The Uvalde disaster displayed the systemic challenges of using police in schools to create safety, including communication issues between a school district and law enforcement.

Yet despite research showing that increased physical security measures do not actually foster safe and inclusive learning environments, U.S. schools spend over $3 billion each year on security services and products, including surveillance cameras, metal detectors and armed guards or police, also known as school resource officers (SROs).

Disturbingly, SROs are more likely to be placed in schools with a high percentage of Black and Latino students, and the SROs who work in such schools are more likely to believe that the students themselves are the biggest threat, while those in white-majority schools are more likely to cite external threats. One study found that increased exposure to police in schools significantly reduced the educational performance of Black boys and lowered their graduation and college attendance rates.

This extra policing of schools comes at a time when legislators are changing laws to subject young people, particularly Black and Latino students and students from low-income backgrounds who are already overpoliced, to increasingly harsher criminal penalties. This trend includes Washington, D.C.’s anticrime bill and Louisiana’s slew of tough-on-crime bills.

The new measures reverse some recent progress: After George Floyd’s murder in 2020, many school districts listened to families and students and removed police from schools amid national protests about law enforcement.

But removing SROs wasn’t enough. Some students returning to school after the pandemic exhibited difficulty readjusting — a manifestation of pandemic loss, racial inequality, discrimination, mental health issues, loss or sickness of family members or caregivers and more. School districts should also have added the kinds of practices that are proven to create safer schools, such as including the voices and needs of students and families in the crafting of inclusive school policies, investing in restorative practices and social and emotional learning efforts, hiring and training culturally responsive school counselors or educators and creating multitiered systems of support.

After the pandemic, teachers didn’t have the resources essential to providing the care that students needed, most notably mental health support. As a result, school districts are now bringing school resource officers back, and it’s a mistake.

Effective approaches to school safety can give students a strong sense of belonging and support in handling conflicts appropriately — before they escalate to violence. To truly keep students safe, federal and state policymakers and school principals should champion policies that support students’ physical and mental well-being and consider proposals that provide federal funds to states and schools committed to reducing harmful disciplinary practices.

As part of this effort, they should support the Counseling Not Criminalization in Schools Act and the Ending PUSHOUT Act, which would divert federal funding away from placing police in schools.

Now is an ideal time for school leaders to rethink their discipline policies and create a safe and welcoming school climate. School shootings are terrifying, but the correct response isn’t more police and metal detectors, especially in majority-Black schools that are already hyper-criminalized.

Students should not have to look back on their middle and high school years, as I do, and associate images of prison with their educational development. All students deserve an education in an inclusive, nurturing environment where they are not only safe, but can also learn and thrive.

Inside a small, mural-covered building just outside Indianola, Mississippi, 14-year-old Tamorris Carter made the rounds, bouncing lightly on his heels.

He stopped frequently to explain objects of interest; pictures of class field trips to civil rights monuments, or a poster he made on “social dominance orientation,” a term that describes one’s tolerance for social inequality. Even in moments of pause, Tamorris found a way to remain in motion. He would smooth down the cap on his head, lean forward to pinch the bubbles of a rainbow-printed fidget toy, and trace the words of his poster.

Tamorris was giving a tour of the Sunflower County Freedom Project, an after-school and summertime educational program where he’d been a student for a little over two years. The Sunflower County Freedom Project is one location of the Freedom Project Network, an organization that gives Mississippi students “holistic and liberatory education experiences.”

At the Freedom Projects, students — called “Freedom Fellows” — learn about Black and Indigenous history, math, reading and public speaking. The program also prepares students for college. Freedom Fellows range in age from third to 12th grade.

Most Freedom Fellows at the Sunflower County location are from Indianola, the county seat. Around 9,000 people live there; 84% of them are Black. Almost a third live in poverty. The town center is ringed by cotton fields, which in July, are low to the ground and bright green. In certain places, neat rows of small plants extend to the horizon. The Mississippi State Penitentiary, a place once described by historian David Oshinksy as “the closest thing to slavery that survived the Civil War,” is a short drive from Indianola. Last year, the town made national news when an Indianola police officer shot an unarmed, Black 11-year-old in the chest.

Other educational programs might prepare students to leave towns like Indianola. But the Freedom Project Network is “not an organization just trying to get kids into college,” emphasized LaToysha Brown, the organization’s executive director. “We are not trying to bring kids in to separate them from the community.”

Instead, she hopes Freedom Fellows will use their education to change their communities for the better.

By early July, the Sunflower County Freedom Project was wrapping up its summer program. Tamorris and other Freedom Fellows moved from class to class in different parts of the building.

“This is our library,” Tamorris announced, cutting through a small room filled with books on Black history, social critique, philosophy, and young adult fiction. From there, he reached a large open area with mats on the ground. “This room is kind of like a gym,” he said. “This is where we do taekwondo.” He paused briefly to demonstrate a move, a decisive punch to the air.

Tamorris walked through a door at the back of the gym, which connected to a classroom with blue walls. A third-grade math class was in session, so he dropped the volume of his voice to a whisper. The classroom’s walls were covered in homemade posters left behind from student presentations. Among others, there were posters with information about historically Black colleges, “The Myth of Racial Progress,” and the signs of ADHD.

The Freedom Project Network takes its name from the Student Nonviolent Coordinating Committee’s Freedom Schools of 1964, whose alums are celebrating the schools’ 60th anniversary this year. The original Freedom Schools opened to educate young Black Mississippians on Black history and political activism. Charlie Cobb, the SNCC member who proposed the idea, wrote that segregated schools in Mississippi were “geared to squash intellectual curiosity and different thinking.” By contrast, Cobb hoped the Freedom Schools would provide Black kids with an education that empowered them. Eventually, these students would use their education to advocate for racial justice in Mississippi.

In 1998, three decades after the last Freedom Schools closed, a group of community members and Teach for America fellows established the Sunflower County Freedom Project.

LaToysha Brown, 28, grew up in Indianola and is a Freedom Fellow at the Sunflower County Freedom Project. From her perspective, the need for the Freedom Project Network was obvious.

“In Indianola schools, students do not receive a quality education,” she said. “When I was a student, we didn’t receive new textbooks, and we weren’t challenged to read many books. Our teachers were amazing with the resources they had. But our schools were under-resourced.”

In Indianola schools, “you’re never going to have an in-depth conversation about enslavement,” Brown said. Instead, the history of racial injustice is limited to “a paragraph or two” in a textbook.

The Freedom Project gave Brown an education she would not have received at school. Now, Brown works with students who attend that same school system — kids like Tamorris.

Tamorris became a Freedom Fellow in eighth grade. By that point, he’d already gained an awareness of injustice, even if he couldn’t label it as such. He remembers looking around his middle school one day and noticing something strange — “I thought, ‘all I see is Black people.’”

He suddenly realized all his classmates were Black, as were the teachers and administrators at his school. This didn’t bother him, exactly, but it did make him wonder: Where are the white kids?

After he joined the Freedom Project, a guest speaker gave him the answer he was looking for: Most white students in Indianola still attend the private Indianola Academy, established to maintain segregation in 1965. Each year, around 400 students attend Indianola Academy. In 2012, then-headmaster Sammy Henderson admitted to The Atlanticmagazinethat the school only enrolled nine Black students, but added that “we also have Hispanic, Indian, and Oriental students.”

For Tamorris, learning about Indianola Academy was a revelation. He had suspected his education was shaped by racism, but he couldn’t bring himself to voice those thoughts. “I didn’t want to be one of those guys that makes everything a conspiracy,” he said. But the guest speaker “gave me reassurance.” He felt — or, allowed himself to feel — that the reality of his life had been kept secret.

He began to see racism throughout his education. At school, teachers had barely mentioned Fannie Lou Hamer, who was born and raised in Sunflower County. They had not taught Tamorris about Juneteenth, either.

Indeed, it started to feel as though his entire life had been shaped by oppression. Tamorris’ mother sometimes struggles to afford food; before, this was an unfortunate fact of life. Now, Tamorris understands it as a symptom of a larger system of racial capitalism. “Screw capitalism,” he said with a grin. “Capitalism is what keeps me broke.”

This kind of thought process is a part of the Freedom Schools’ “liberatory pedagogy,” a teaching style that takes for granted that, according to Brown, “People already know what’s happening to them. They just need the language.”

Brown acknowledges that Tamorris is an extraordinary student. Still, she said, “a lot of our students walk into our space feeling like something just isn’t right in their lives. We fill in the gaps. We give them language. We allow them to share their experiences with each other about what’s happening in their community.”

On July 12, Tamorris and a few other freedom fellows gathered to present a project of their choosing to their family members and supporters. Tamorris gave a presentation on social dominance orientation, which he argues plays a role in the continuation of oppressive systems.

These presentations are a major aspect of the Freedom Project’s teaching style; they are intended to get Freedom Fellows comfortable educating their community members. From Brown’s perspective, a student like Tamorris is perfectly capable of analyzing society by himself, without the assistance of the Freedom Project. But to Brown, analysis is only part of the process.

“I said, ‘Great, you have this great big analysis of the world,” said Brown of Tamorris. “‘Now, I want you to apply that. How can you use that analysis to organize with the people around you?’”

NEW PALTZ, N.Y. — At the end of a semester that presaged one of the hottest summers on record, the students in Associate Professor Michael Sheridan’s business class were pitching proposals to cut waste and emissions on their campus and help turn it into a vehicle for fighting climate change.

Flanking a giant whiteboard at the front of the classroom, members of the team campaigning to build a solar canopy on a SUNY New Paltz parking lot delivered their pitch. The sunbaked lot near the athletic center was an ideal spot for a shaded solar panel structure, they said, a conduit for solar energy that could curb the campus’s reliance on natural gas. 

The project would require $43,613 in startup money. It would be profitable within roughly five years, the students said. And over 50 years, it would save the university $787,130 in energy costs.

“Solar canopies have worked for other universities, including other SUNY schools,” said Ian Lominski, a graduating senior who said he hopes to one day work for the New York State Department of Environmental Conservation. “It’s well within the realm of possibility for SUNY New Paltz.” 

Sheridan’s course is an example of an approach known as “campus as a living lab,” which seeks to simultaneously educate students and reduce the carbon footprint of college campuses. Over the past decade, a growing number of professors in fields as diverse as business, English and the performing arts have integrated their teaching with efforts to minimize their campuses’ waste and emissions, at a time when human-created climate change is fueling dangerous weather and making life on Earth increasingly unstable.

Engineering students have helped retrofit buildings. Theater students have produced no-waste productions. Ecology students have restored campus wetlands. Architecture students have modeled campus buildings’ airflow and worked to improve their energy efficiency. The efforts are so diverse that it’s difficult to get a complete count of them, but they’ve popped up on hundreds of campuses around the country.

“I think it’s a very, very positive step,” said Bryan Alexander, a senior scholar at Georgetown University and author of the book “Universities on Fire: Higher Education in the Climate Crisis.” “You’ve got the campus materials, you’ve got the integration of teaching and research, which we claim to value, and it’s also really good for students in a few ways,” including by helping them take action on climate in ways that can improve mental health.

That said, the work faces difficulties, among them that courses typically last only a semester, making it hard to maintain projects. But academics and experts see promising results: Students learn practical skills in a real-world context, and their projects provide vivid examples to help educate entire campuses and communities about solutions to alleviate climate change.

From the food waste students and staff produce, to emissions from commuting to campus and flying to conferences, to the energy needed to power campus buildings, higher education has a significant climate footprint. In New York, buildings are among the single largest sources of carbon emissions — and the State University of New York system owns a whopping 40 percent of the state’s public buildings. 

About 15 years ago, college leaders began adding “sustainability officers” to their payrolls and signing commitments to achieve carbon neutrality. But only a dozen of the 400 institutions that signed on have achieved net-zero emissions to date, according to Bridget Flynn, senior manager of climate programs with the nonprofit Second Nature, which runs the network of universities committed to decarbonizing. (The SUNY system has a goal of achieving net-zero emissions by 2045, per its chancellor, John B. King Jr.) 

Campus sustainability efforts have faced hurdles including politics and declining enrollment and revenue, say experts. “Higher ed is in crisis and institutions are so concerned about keeping their doors open, and sustainability is seen as nice to have instead of essential,” said Meghan Fay Zahniser, who leads the Association for the Advancement of Sustainability in Higher Education.

But there’s change happening on some campuses, she and others noted. At Dickinson College, in Pennsylvania, a net-zero campus since 2020, students in statistics classes have run data analyses to assess why certain buildings are less efficient than others. Psychology students studying behavior change helped the campus dining hall adopt a practice of offering half, full and double portions to cut down on food waste. Physics students designed solar thermal boxes to boost renewable biogas production on an organic farm owned by the college. 

Neil Leary, associate provost and director of the college’s Center for Sustainability Education, teaches classes in sustainability. Last fall’s students analyzed climate risks and resilience strategies for the campus and its surrounding county and then ran a workshop for community members. Among the recommendations emerging from the class: that athletic coaches and facilities staff receive training on heat-related health risks.

Similarly, at SUNY Binghamton, Pamela Mischen, chief sustainability officer and an environmental studies professor, teaches a course called Planning the Sustainable University. Her students, who come from majors including environmental studies, engineering and pre-law, have helped develop campus green purchasing systems, started a student-run community garden and improved reuse rates for classroom furniture. 

And across the country, at Weber State University in Utah, students have joined the campus’s push toward renewable energy. Engineering students, for example, helped build a solar-powered charging station on a picnic table. A professor in the school’s construction and building sciences program led students in designing and building a net-zero house.

On the leafy SUNY New Paltz campus about 80 miles north of Manhattan, campus sustainability coordinator Lisa Mitten has spent more than a decade working to reduce the university’s environmental toll. Among the projects she runs is a sustainability faculty fellows program that helps professors incorporate climate action into their instruction. 

One day this May, Andrea Varga, an associate professor of theatre design and a sustainability fellow, listened as the students in her honors Ethical Fashion class presented their final projects. Varga’s class covers the environmental harms of the global fashion industry (research suggests it is responsible for at least 4 percent of greenhouse emissions worldwide, or roughly the total emissions of Germany, France and the United Kingdom combined). For their presentations, her students had developed ideas for reducing fashion’s toll, on the campus and beyond, by promoting thrifting, starting “clothes repair cafes” and more.

Jazmyne Daily-Simpson, a student from Long Island scheduled to graduate in 2025, discussed expanding a project started a few years earlier by a former student, Roy Ludwig, to add microplastic filters to more campus washing machines. In a basement laundry room in Daily-Simpson’s dorm, two washers are rigged with the contraptions, which gradually accumulate a goopy film as they trap the microplastic particles and keep them from entering the water supply.

Ludwig, a 2022 graduate who now teaches Earth Science at Arlington High School about 20 miles from New Paltz, took Varga’s class and worked with her on an honors project to research and install the filters. A geology major, he’d been shocked that it took a fashion class to introduce him to the harms of microplastics, which are found in seafood, breast milk, semen and much more. “It’s an invisible problem that not everyone is thinking about,” he said. “You can notice a water bottle floating in a river. You can’t notice microplastics.”

Around campus, there are other signs of the living lab model. Students in an economics class filled the entryway of a library with posters on topics such as the lack of public walking paths and bike lanes in the surrounding county and inadequate waste disposal in New York State. A garden started by sculpture and printmaking professors serves as a space for students to learn about plants used to make natural dyes that don’t pollute the environment. 

In the business school classroom, Sheridan, the associate professor, had kicked off the student presentations by explaining to an audience that included campus facilities managers and local green business leaders how the course, called Introduction to Managing Sustainability, originated when grad students pitched the idea in 2015. The projects are powered by a “green revolving fund,” which accumulates money from cost savings created by past projects, such as reusable to-go containers and LED lightbulbs in campus buildings. Currently the fund has about $30,000. 

“This class has two overarching goals,” said Sheridan, who studied anthropology and sustainable development as an undergraduate before pursuing a doctorate in business. The first is to localize the United Nations global goals for advancing sustainability, he said, and the second is “to prove that sustainability initiatives can be a driver for economic growth.” 

In addition to the solar canopy project, students presented proposals for developing a reusable water bottle program, creating a composter and garden, digitizing dining hall receipts and organizing a bikeshare. They gamely fielded questions from the audience, many of whom had served as mentors on their projects.

Jonathan Garcia, a third-year business management major on the composting team, said later that he’d learned an unexpected skill: how to deal with uncooperative colleagues. “We had an issue with one of our teammates who just never showed up, so I had to manage that, and then people elected me leader of the group,” he said later. “I learned a lot of team-management skills.”

The solar panel team had less drama. Its members interviewed representatives from the New York State Energy Research and Development Authority, Central Hudson Gas & Electric and a local company, Lighthouse Solar, along with Mitten and other campus officials. Often, they met three times a week to research and discuss their proposal, participants said.

Lominski, the senior, plans to enroll this fall in a graduate program at the SUNY College of Environmental Science and Forestry, in Syracuse. Before Sheridan’s class, he said, he had little specific knowledge of how solar panels worked. The course also helped him refine his project management and communication skills, he said. 

His solar panel teammate Madeleine Biles, a senior majoring in management, transferred to New Paltz from SUNY Binghamton before her sophomore year because she wanted a school that felt more aligned with her desire to work for a smaller, environmentally minded business. 

An avid rock climber whose parents were outdoor educators, she’d developed some financial skills in past business classes, she said, but the exercises had always felt theoretical. This class made those lessons about return on investment and internal rate of return feel concrete. “Before it was just a bunch of formulas where I didn’t know when or why I would ever use them,” she said. 

This summer, Biles is interning with the Lake George Land Conservancy, and hopes to eventually carve out a career protecting the environment. While she said she feels fortunate that her hometown of Lake George, in New York’s Adirondack region, isn’t as vulnerable as some places to climate change, the crisis weighs on her. 

“I think if I have a career in sustainability, that will be my way of channeling that frustration and sadness and turning it into a positive thing,” she said. 

She recently got a taste of what that might feel like: In an email from Sheridan, she learned that her team’s canopy project was chosen to receive the startup funding. The school’s outgoing campus facilities chief signed off on it, and, pending approval from the department’s new leader, the university will begin the process of constructing it.

“It’s cool to know that something I worked on as a school project is actually going to happen,” said Biles. “A lot of students can’t really say that. A lot of projects are kind of like simulations. This one was real life.”

Hirahara said she and her friends didn’t consider the racial implications of their group’s name until one of their fathers objected: “The Klan is very bad!”

The group consisted of Hirahara, who is Japanese-American, two Black girls and a White Jewish girl. They attended Loma Alta Elementary, a racially diverse school in Altadena, Calif., that stood out from many others in the Pasadena Unified School District (PUSD), especially its high schools, which were more racially homogenous.

“I really treasured the fact that we could form these interracial and intercultural relationships,” Hirahara said of her school, where, she recalled, students acknowledged racial differences, but weren’t fixated on them.

By 1970, the racial makeup of PUSD schools would command the attention of the entire country. A U.S. district court judge determined the school system had “knowingly assigned” students to schools by race and ordered it to desegregate based on the 1954 Brown v. Board of Education decision that “separate but equal” schools were unconstitutional. To racially integrate, PUSD launched what CBS News and The New York Times described then as the most substantial busing program outside the South.

Seventy years after the Brown decision on May 17, 1954, PUSD is still rebounding from the white flight that followed its desegregation order. More than 27,700 school-age youth live in Pasadena, Altadena and Sierra Madre, the communities served by the district, but only about half of them attend public school.

With 133,560 residents, Pasadena has one of the densest concentrations of private schools in the country, according to school officials. But the moms in the community who support public schools have organized to create a more equitable and diverse educational landscape.

They have teamed up with local educational organizations to advocate for the school district, and by extension, for racially and economically diverse schools. They have reached out to families with preschoolers, joined public school tours and gone door-to-door to reframe the narrative around PUSD. District officials, for their part, have expanded magnet and dual language immersion offerings, among other competitive programs, at schools to attract families from a wide range of backgrounds.

Families and officials have also worked together to educate realtors. It turns out that some of them dissuaded homeowners from enrolling children in PUSD, contributing to the exodus to private schools and, more recently, charter schools.

Changing negative perceptions that date back to school desegregation during the 1970s hasn’t been easy, they said. Back then, the backlash to the busing program occurred almost as soon as it started, with a recall campaign against school board members and a near 12-percentage-point drop in white student enrollment. Ronald Reagan, who was California’s governor at the time, stoked the fire when he signed legislation that prohibited busing without parental consent.

Today, advocating for Pasadena’s public schools is all the more challenging when considering that more than 40 private schools have been established in PUSD’s boundaries; the district has 23 public schools. In interviews, community members told The 19th that the proliferation of private schools has enabled white, middle- and upper-class families to evade public schools in the five decades since court-ordered desegregation.

“We really, truly haven’t recovered from the very pervasive belief in the area that PUSD schools are not up to snuff,” said Brian McDonald, who served as PUSD’s superintendent for nine years before stepping down in 2023.

California is not usually a place associated with segregation, though segregation has historically been a problem in the state. A 1973 report by the U.S. Commission on Civil Rights concluded that school segregation there and elsewhere in the West is frequently “as severe as in the South.” A report released last month by the Civil Rights Project at UCLA — “The Unfinished Battle for Integration in a Multiracial America – from Brown to Now” —  ranked California as the top state in the country where Black and Latino students attend schools with the lowest percentages of white students.

“California has gone through a major racial transition,” said Gary Orfield, one of the authors of the report and the co-director of the Civil Rights Project at UCLA. “It was an overwhelmingly White state in terms of school enrollment at the time of the Brown decision, but it’s now, of course, a state that is overwhelmingly non-White in terms of student enrollment. That’s basically caused by tanking birth rates and immigration.”

Fueling segregation, Orfield said, is the fact that California has largely lacked state policies designed to racially balance schools since the 1960s and 1970s, when court orders brought about change.

In Pasadena, some residents say that the school district’s reputation is improving and more people want to invest and enroll their children in public schools. Although white and Asian-American students remain underrepresented in PUSD, the White student population has slightly increased over the past 20 years despite the drop in the city’s White population during that period.

After failed attempts, Pasadena voters have approved ballot measures to increase funding for local schools in recent years, enabling the district to make millions of dollars in upgrades. The district has also received national recognition for its academic programs, school tours are packed and young parents now tend to view diversity as an asset, its supporters say.

“Most school districts across the country have given up on integration. It’s not on the radar screen,” said Richard Kahlenberg, who has authored studies on PUSD and is director of housing policy at the Progressive Policy Institute, a think tank in Washington, D.C. “Pasadena, along with a number of other forward-looking communities, is trying to do something about that. They haven’t reached all their goals, but I’m inspired that there is a critical mass of parents who recognize the benefits of diversity for all students.”

During a recent information session for prospective public school parents, Nancy Dufford, executive director of the Pasadena Education Network (PEN), which works to get families involved in district schools, told the audience: “Probably, a lot of you were told when you moved here that you couldn’t send your kids to public school.”

She was stunned to find out that none of the families had actually heard such comments. It was the first time she had spoken to a group of parents who hadn’t been warned away. In Pasadena, Dufford said, it has been tradition for established families not to send their children to public schools. “So many people live here for long periods of time,” she said. “So you have generations of families here who have that message.”

The message ends up making its way to newer Pasadenans. Dufford said she heard it herself after becoming a mother in the 1990s, shortly after relocating to the city. In fact, PEN, the group she runs today, was started in 2006 by a group of preschool parents who had heard the same thing yet refused to listen.

They were among the parents who asked questions like, “Why do people say the schools aren’t good?”

Kimberly Kenne, president of the PUSD Board of Education and one of the founding members of PEN, said that she also wondered about this “pervasive narrative” when she moved to town in the early 1990s. She wasn’t aware of the bias against public schools in Pasadena, though her husband, who was raised in the city, attended private school when the desegregation order came down.

After their first child was born in 1997, Kenne considered enrolling him in the neighborhood public school — only to be admonished by fellow parents. “Are you sure you’re going to share the values of the other parents at public school?” she recalled them asking.

She enrolled her son in a private school, but changed her mind. One reason is that the school wasn’t equipped to meet his needs as a neurodivergent child. Another is that the private school lacked racial diversity in the student body, something that mattered to her.

Jennifer Hall Lee, vice president of PUSD’s Board of Education, also enrolled her daughter, who is now 20, in private school — regretting the decision when she realized her daughter didn’t seem comfortable interacting with people from a wide range of backgrounds.

Lee herself had gone to a public high school in Atlanta in the 1970s that had equal percentages of Black and White students. After switching her daughter to public school, Lee noticed that the child’s worldview changed.

“She would talk to me about the kids in the schools, from first-generation immigrant kids to foster youth,” Lee said. “She began to really understand the differences in socioeconomic status and understand that people lived in apartments and not everybody owned a home. She started understanding the full breadth of her community.”

In a city where the median home sale price is $1.1 million and the median household income is almost six figures, it’s confusing for newcomers to understand why the school system has a poor reputation since affluence in a community typically translates into quality in its public schools.

Pasadena, however, has become known as “a tale of two cities,” a place where the gap between the rich and the poor has only widened and the two groups don’t mingle socially or academically. At $97,818, the median household income is just above the state’s and $23,000 above the nation’s. At the same time, the city’s poverty rate of 13.4 percent is slightly higher than the state and national rate.

When the school district’s critics mention that its test scores are lower than those in surrounding school systems, supporters respond that the city has a wealth gap that’s largely absent from the more homogeneous neighboring suburbs. Many of the detractors, Dufford said, are also unaware that PUSD’s “bad” reputation coincided with the 1970 desegregation order that accelerated the departure of white, middle- and upper-income families from the district.

White flight out of Pasadena has been traced back as far as the 1940s. The reasons include lower birth rates among white families, an economic downturn in the aerospace industry that limited employment opportunities and the restructuring of neighborhoods to make way for freeways. By 1960, the racial demographics of the city were also changing, with communities of color expanding rapidly. The next year, PUSD lost about 400 students when the mostly white community of La Cañada broke away from the district to form its own separate school system, which to this day is ranked as one of the state’s best. In 1976, La Cañada Flintridge became its own city.

“The fact that people are willing to create whole new municipalities, so they don’t have to integrate — that should really wow people,” said Shannon Malone, PUSD’s senior director of principals, who added that her views were not the school district’s but her own. “You would rather create a whole new city than to let your child sit next to a person of color. I don’t think people have a full understanding of that at all.”

Having lived through the desegregation order, Hirahara, who is now an award-winning mystery writer, wishes more people knew about the history of the city’s schools. In 2016, she received a grant from the Pasadena Arts & Culture Commission and the City of Pasadena Cultural Affairs Division to present “Loma Alta: Tales of Desegregation,” a talk at a public library that featured her and two other district alumni sharing their experiences.

“So many people don’t even know that it was the first West Coast school district to get the order to desegregate, so it’s a very unique and telling experience of why we’re still dealing with issues of race today,” Hirahara said.

When Hirahara was enrolled in Loma Alta, about half of its students were Black. It was one of Pasadena’s top-performing elementary schools, which the 1973 report from the Civil Rights commission attributed to the fact that many of the students came from middle-class households. Other high-achieving schools in the district with large Black populations included Audubon Primary School and John Muir High School. Six students at John Muir were accepted into the elite California Institute of Technology (Caltech) in 1972, a rare feat that prompted Caltech’s then-president to write about the accomplishment in the local newspapers.

The Brown v. Board decision had the unintended consequence of costing tens of thousands of Black educators their jobs as many white schools did not want to employ these teachers and principals after integration. The consequences have endured for decades. In 2021, about 15 percent of public school students nationwide were Black, but only 6 percent of public school teachers nationwide were, according to a forthcoming report by the Southern Education Foundation, a nonprofit that works to advance equitable education policies.

Malone, who is Black and was bused to schools in Los Angeles, underscored the results of studies that show that students of color excel when they have Black teachers, demonstrating better academic and behavioral outcomes. But when Black children attend integrated schools, their support systems don’t usually accompany them, she said.

The achievements of students at racially diverse schools in the district didn’t stop the parents bent on leaving PUSD from doing so, administrators complained to federal officials in 1973. The biggest obstacle preventing the district from truly becoming integrated, the administrators said, was “white flight.” The Civil Rights commission’s report quoted one administrator making a remark that could have come from a PUSD supporter today: “White parents don’t take time to see whether the system is bad or not. They simply listen to people who criticize the district without foundation.”

What’s different is that now the district has an army of moms actively challenging these attitudes. Victoria Knapp is one of them, but it took time and trust in herself before she became a public school crusader.

When Knapp entered grade school in Pasadena in the 1970s, she heard that children her age were being bused from one neighborhood to another, but she didn’t understand why it was being done or what it was like. Knapp did not attend the city’s public schools.

“My schools were predominantly white, predominantly Catholic and predominantly middle class or above,” she said.

She had some familiarity with public schools because her mother taught for the Los Angeles Unified School District, but she didn’t know that a contentious debate about integrating them had unfolded in her own community. Years later, after the birth of her older son, she felt pressure from fellow moms to send her children to private school. The aversion to public school in her moms’ group made her reflect on her city’s past. She thought to herself: “You mean to tell me that whatever was going on here 40 years ago is still going on?”

Still, her Catholic school upbringing and the nudging from the private school enthusiasts led Knapp, chair of the Altadena Town Council’s executive committee, to rule out PUSD. First, she and her husband enrolled their eldest son in a parochial school. Then they tried a nonsectarian private school. The couple felt that both schools exposed their children to experiences and behaviors they did not appreciate, like the sense of entitlement expressed by some of their classmates. Knapp, for the first time, began to consider an alternative.

“It did seem counterintuitive to me that I was going to have this relatively homogenous group of moms dictate what we were going to decide for our own kid,” she said.

After touring PUSD schools, Knapp questioned the idea that they were inferior to the city’s private schools. She wondered, “What’s not good? Is it that our public schools are predominantly Black and Brown children?”

When some parents raised safety concerns, she responded that elementary schools aren’t typically dangerous and that fights, gun violence and truancy occur at private and public schools alike. “They could never really articulate what safety meant,” Knapp said. “What safety meant was they didn’t want their child in an integrated, diverse school. They just didn’t. And that’s exactly where I wanted my privileged white sons to be.”

Both of her sons, a sixth grader and an 11th grader, have now attended public school for years. Her younger son attended Hall of Famer Jackie Robinson’s alma mater, Cleveland Elementary School.

Knapp became an active PUSD parent, serving as a PTA president at Altadena Arts Magnet, the school her younger son attended next, and an ambassador for the Pasadena Education Network, a role that has her regularly participate in school tours. Going on tours allows her to field questions from prospective parents. What the families see often surprises them, Knapp said.

“They think they’re going to see chaos and mayhem, then they come in,” she said. “Altadena Arts is an inclusion school, so kids of all neurodiversities are included in the same classroom. It’s socioeconomically diverse, it’s racially diverse, it’s gender diverse, it’s very integrated. You walk up there and it’s like, ‘This is what a school should look like.’”

Karina Montilla Edmonds, who moved to Pasadena in 1992 to attend Caltech, never doubted the city’s public school district. When her now 22-year-old daughter was entering kindergarten, Edmonds and her former husband turned down the chance to send her to the neighboring San Marino Unified School District (SMUSD), which ranks as one of the state’s top 10 school systems. Her then-husband taught for SMUSD, qualifying their eldest daughter for an interdistrict transfer to the suburb where the median household income is $174,253 and more than 85 percent of students are proficient in reading and math.

Edmonds wasn’t interested. “At the time, I was like, ‘That’s not my school. That’s not my community. I have a school two blocks away. Why wouldn’t I go there?’”

The decision appalled many of her fellow parents. “People thought I was nuts,” she said. “Luckily, I have a PhD in aeronautics from Caltech, so they knew I wasn’t stupid, but they definitely thought I was crazy.”

The mom of three from Rhode Island didn’t fear that her children wouldn’t get a good education in Pasadena’s public schools because she excelled in the public education system in her state while growing up in a household of few resources, raised by parents with limited formal education. “I thought I was rich because everybody around me was on public aid,” she said. When she attended a competitive public high school, she learned just how economically disadvantaged her family was. “I was like, ‘Oh, wait, I’m poor.’”

She now serves on the board of the Pasadena Educational Foundation, a nonprofit focused on developing community partnerships to help the city’s public schools excel. The organization also works with the Pasadena-Foothills Association of Realtors to educate real estate agents about the public schools since some realtors had a history of discouraging homebuyers from enrolling their children in PUSD. McDonald, the former superintendent, said that it happened to him when he was buying a home several years ago.

“She advised me to put my kids in every other school and district except for PUSD,” he said. “But I’m happy to say that through the efforts of the district and the Pasadena Educational Foundation, primarily utilizing the realtor initiative, we were able to change a few minds.”

Edmonds agrees that educating realtors is an important step. Her perspective on public schools and the surrounding communities, she added, also comes from the fact that her ex-husband taught in Pasadena before San Marino. Was he suddenly a better teacher because he moved from a less affluent school district to a more affluent one? She didn’t think so. She also didn’t compare the two district’s test scores because their populations are different. Pasadena Unified has significantly more low-income students, foster youth, English language learners and Black and Brown students than San Marino Unified, which is predominantly White and Asian American.

“To me, that’s part of the enrichment of getting to be with and learn from a broader part of our community,” she said, adding that children don’t suffer because they attend school in diverse environments.

The idea of seeking out or avoiding schools based on demographics concerns her.

“I feel like our democracy depends on an educated population,” she said. “I think every child should have access to excellent education and have an opportunity for success because I know the opportunities that I had given to me through the public school system.”

The year after McDonald became the PUSD superintendent in 2014, he wrote a column in the local paper describing the difficulties the district was experiencing because of the high percentage of parents sending their children to private school. He estimated that the district was losing out on about $14 million because of declining enrollment, money that could help PUSD prevent school closures, teacher layoffs and cuts to student services.

But he also touted the district’s variety of programs for students such as dual language immersion schools and International Baccalaureate, as well as the piloting of a dual enrollment program with the local community college. Since then, the district has expanded its initiatives and created new ones. In addition to Spanish and Mandarin, the district’s dual language immersion tracks now include French and Armenian. From 2013 to 2022, PUSD also received three federal magnet assistance program grants that allow it to bring more academic rigor to its schools.

“We lose enrollment because people have a negative perception of our schools, so I think the idea of a magnet theme, whether it’s arts or early college, or a dual-language program, can really get people excited about something that their students are really interested in or maybe a value that their family has, let’s say, around the arts,” said Shannon Mumolo, PUSD’s director of

magnet schools, enrollment, and community engagement. Schools with themed magnet programs, she added, can sway families who weren’t interested in PUSD to consider at least going on a school tour.

Enrollment at PUSD’s John Muir High School has increased since it became an Early College Magnet in 2019, Mumolo said. Across the board, enrollment of students from underrepresented groups — white and Asian American — have gone up since the school district expanded its academic programs over the past decade.

“But I also want to make sure to emphasize that the schools have maintained their enrollment of their Black and Latino students,” Mumolo said. “We want to make sure that we’re keeping our neighborhood students and maintaining enrollment for those groups.”

The former superintendent also touts PUSD’s Math Academy, which The Washington Post in 2021 lauded as “the nation’s most accelerated math program.” The course allows gifted middle school students to take classes, such as Advanced Placement Calculus BC, that are so rigorous that only a small percentage of high school seniors take them.

Kenne, the school board president, said that her children, now both in their 20s, were gifted math students. The Math Academy was not available when they were in grade school. She and her husband switched them out of PUSD in high school, in part, because at the time they had more opportunities to excel in math in private school, she said, acknowledging that it was a controversial choice for a parent who advocates for public education. 

“People do have reasons,” Kenne said of some parents who choose private school. But she also said that private school overall wasn’t especially rigorous for her children. “My son calculated that he didn’t need to do homework for some classes to get a decent grade,” she said.

By introducing a wide variety of academic programs, including in math, PUSD has challenged the gap between what outsiders perceive it to be and what the district actually is, according to McDonald. “I think if we had not implemented those programs, the declining enrollment would have been much more acute,” he said.

Kahlenberg, the researcher, agrees. He said data suggests that when middle-class families get the right incentives to go to a public school, even one that’s outside their neighborhood, they do.

Since the busing integration program did not succeed in the district, Kahlenberg, in his studies of the school district, recommended that PUSD take creative approaches to lure in middle-income families. That includes introducing unique academic programs as well as developing or deepening partnerships with institutions in or around Pasadena — Caltech, NASA Jet Propulsion Laboratory, the Pasadena Playhouse, Art College Center of Design, the Norton Simon Museum, the Huntington Library.   

But the focus on winning parents back has led to some tension, Kenne said.

“Sometimes a message that we’ve heard in the last 10, 20 years is, do we care more about marketing to the people who don’t come to our district, or working hard for the people who are already here?” Kenne said. “Because sometimes the public-facing message seems to be all about getting kids back, and it makes the people in the system go, ‘Am I not important to you? I’m already here.’”

Nationwide, Black students who attended school in the late 1960s were more likely to be in integrated classrooms than Black youth today. Supreme Court decisions, such as 1991’sBoard of Education of Oklahoma City v. Dowelland 2007’s Parents Involved in Community Schools v. Seattle School District No. 1, have contributed to the resegregation of the nation’s schools by phasing out court-ordered busing and making it harder to racially balance schools, according to experts.

Kahlenberg said schools nonetheless have a duty to continue trying to integrate — if not by race, then by class.

“The children of engineers and doctors bring resources to a school, but so do the children of recent immigrants or children whose parents have struggled,” Kahlenberg said. “The more affluent kids benefit as well from an integrated environment. When people have different life experiences they can bring to the discussion novel ideas and new ways of thinking, and that nicely integrated environment is possible in a place like Pasadena.”

Hirahara, for one, still cherishes her childhood in the school district, back when she befriended the girls in the C.L.A.N. As schools across the nation have largely re-segregated, she fears that too few young people get to experience what she did.

“I’m so glad that I had that kind of upbringing,” she said, “and I think it prepared me better for life.”

Even as we approach the 70th anniversary of Brown vs. Board this May, key parts of its history remain buried. Reporting has begun to engage with some of the lost, and often complex, aspects of Brown’s legacy, such as the mass firing of Black educators following the Brown decision.

At least one critical piece, however, still remains largely unknown: NAACP lawyers submitted a letter with evidence about segregation’s impact on white students as well as Black students.

In the letter, signed by more than 30 social scientists, Thurgood Marshall and his team at the NAACP warned that, in addition to its more well-known harms to Black educational opportunity, segregation also has detrimental effects on white children.

If school integration is going to reach its full potential — for schools and for democracy in general — we should take a close look at this neglected letter and its chilling resonances with contemporary society. The letter notes that “segregation imposes upon individuals a distorted sense of social reality” that can take shape in different ways for white students.

As we approach a milestone for Brown, let’s seize this opportunity to recommit to one of its primary goals: integrated public schools as “the very foundation of good citizenship.”

This requires thinking about Brown more expansively than we have in the past. Thinking of school integration not as an individual benefit for one group of students but as an essential component of a healthy multicultural democracy.

Indeed, research clearly illustrates that white students in diverse schools gain social awareness and intercultural understanding among other benefits. In a recent study, my colleagues at the University of Massachusetts and I compared white students in segregated white schools with those in racially diverse schools. We found that the latter reported higher levels of civic engagement and a sense of belonging.

This is just one example in a long history of social science research that connects racial contact to enhanced participation in a diverse democracy — including increased sociocultural empathy and reduced belief in stereotypes.

Revisiting Brown, 70 years later

The Hechinger Report takes a look at the decision that was intended to end segregation in public schools in an exploration of what has, and hasn’t, changed since school segregation was declared illegal.

The NAACP letter warns that those on the top of a social hierarchy can experience “confusion, conflict [and] moral cynicism” when trying to reconcile a contradiction between the stated “importance of justice and fair play by the same persons and institutions who, in their support of racial segregation and related practices, seem to be acting in a prejudiced and discriminatory manner.”

It notes that those majority members, in their effort to make sense of this apparent paradox, may “develop patterns of guilt feelings” or embrace “rigid stereotypes.”

Others may “attempt to resolve this conflict by intensifying their hostility toward the minority group,” the letter notes.

And in perhaps its most prophetic line, the letter warns that racial hostility is often accompanied by an “uncritical idealization of all authority figures” and “the development of a social climate within which violent outbreaks of racial tensions are likely to occur.”

If that sounds familiar, it’s for good reason. And it’s deeply troubling. Consider the recent steady rise of hate incidents that the Southern Poverty Law Center has labeled the “Trump effect.”

The former president’s current campaign is even more explicit in its embrace of racial stereotypes and dictatorial rule.

Surely, part of Trump’s support is connected to those “feelings of hostility” the letter described.

We see this today in efforts to ban curriculum on the history of school desegregation or even to outlaw any analysis of racism that inspires feelings of “discomfort, guilt, anguish, or any other form of psychological distress.”  

Our current political climate might look different if the court had emphasized the benefits for all students in its final Brown ruling; of course, it did not.

Segregation’s impact on white students is noticeably absent from one of the decision’s most iconic lines: “Segregation of white and colored children in the public schools hasa detrimental effect upon the colored children.”

Taking its cues from the court ruling, our country pursued Brown’s mandate narrowly, as an often one-way form of desegregation. Families of color bore a disproportionate burden — long bus rides, the white mobs — because it was presumed that desegregation was for their benefit only.

Thankfully, there are vibrant existing venues for a more expansive conception of school integration, much of which is organized by the National Coalition on School Diversity.

In some cities, youth organizers are carrying forward the similarly forgotten legacy of student protest for school integration. The student organizing operates according to a reimagined notion of Brown’s mandate, described as the 5 Rs of real integration: race and enrollment, resources, relationships, restorative justice and representation.

There are also efforts underway across the country to organize white and/or affluent parents — of course, the chief opponents of desegregation — to choose racially diverse schools for their children.

Research gives us reason to feel hopeful that these kinds of efforts can usher in a new era of school integration. Recent polling illustrates that white parents opposed to school integration are likely to change their opinions after learning more about the impact of segregation on white children: the exact results the NAACP letter warned us about 70 years ago.

We need to address segregation as a collective challenge and create a new approach that breaks from the one-sidedness of the past. Even as Brown turns 70, it’s not too late.

The seeds were planted long ago, and our current moment gives us plenty of motivation to help them grow.
